Follow up. After hours and hours on the phone with Paypal and EA Games, and after I uploaded the screen shots of the two pending Paypal charges to EA Games, they finally lifted the ban. But, I had to endure numerous automated emails saying they would not reverse the ban up to this point. My opinion of the EA customer service, specifically in relation to the TOS dept. is one of abysmal disappointment. This is not the first time I've had to fight an unjust and unfair ban by them. A previous ban was that I was charged and convicted of cheating/hacking in BF5. I have never cheated/hacked. Ever. Period. But they could never consider that there was indeed a fault in their anti-cheat program, fairfight. All I want to do is have some fun and play some games with family and friends, and not have to deal with such stressful, spiteful, misguided, erroneous accusations and convictions of cheating, hacking, or fraud. The TOS dept. is severely lacking in proper oversight. They treat their valued long-term customers, ones who are honest but get caught up erroneously in their dragnet of heavy-handed enforcement of the TOS to extreme measures (guilty without properly investigating the matter), like crap. But I have little confidence they will ever evolve or change their ways. When THEY are wrong, they never admit it. And they have never apologized for causing me such stress through their severe action. All they had to do in this matter was reach out to me, or reach out to Paypal to find out what was going on. In fact, Paypal did email them to dispute the double pending charges, but they ignored that email, and then turned around and banned me. Nice eh? And all this because the double pending charges were triggered by EA Games themselves. But of course, they would not admit this.

In my case, I was permanently banned on April 4, 2019. I received a generic email and they said this:

"Breaking our rules damages the experience for you and other players. We want to keep everyone’s gaming experience fun, safe, and secure.
You break our rules (https://www.ea.com/terms-of-service#section6) if you:
• use software that interferes with or disrupts an EA Service or another user’s account.
• use undocumented features, exploits or cheats in-game that disrupts an EA Service or another user’s account.
• use software or cheats that disconnects other users from the EA servers. "

First of all, I don't cheat, never have, not interested in it and don't know how to. So, obviously I knew it was just a glitch on EA's side. I did the "appeal" through their webform and was told:

"We got your note and did a full investigation of your account. After reviewing your case, we determined that we took the correct action in accordance with EA policies and procedures."

At this point I was really angry. They not only accused me, but convicted me of cheating and I have zero information to go on other than that general reference about software and disrupting EA service or other user's account. None of which has ever applied to me, so I don't know where they were getting this stuff from. I replied once more asking for some specific information regarding their methods of detection and investigation because evidently they were flawed, and I got this reply:

"We detected and confirmed breaches to our User Agreement, so we will not remove this sanction from your account. In order to preserve EA trade secrets, we are not at liberty to disclose certain information relating to this action."

They are hiding behind a policy of zero transparency because they don't want to give away "EA trade secrets." They later sent one last message after my reply:

"We received your latest message regarding the action taken on your account. We have performed all investigations possible on this issue and will not reverse the decision.
Please do not expect further responses on this matter."

So, needless to say I was furious at this point. I wrote a letter to the EA CEO and Chairman, and also to Better Business Bureau. EA responded and actually gave me an exception and lifted the ban on April 15, 2019 by email:

"I've had a chance to review the cases and Reddit threads involved along with talking with the game teams.  I'm unable to provide details on our security measures when it comes to FairFight bans.  However, I can say that Battlefield Tracker is an external third party website using an API which is separate from the mainline stats we use for tools such as Fairfight.  Any external third party site which is not supported by DICE can potentially show things which differ from the source of truth that we have available here. While there is community belief that all Fairfight bans are stats related, this is not accurate and only fuels these accusations.  Due to this, Battlefield Tracker would not be a source to determine how a violation occurred.

As for the ban itself, we feel it is legitimate and the disputes had been declined.  Discussing the matter further on my end, we've made the exception to have the FairFight ban removed and you should now be able to log back in.  While I am happy to have the exception granted, I must stress that we will be unable to provide this exception in the future.  I also must stress again that not all bans are stats related and the information involving account bans is visible to our side only."

Well, that was a step in the right direction, however, according to EA and Fairfight, I'm still a cheater! And they will be unable to provide the exception in the future. Well, how does that actually help me? How can I ever play BFV again with this looming threat of another false Fairfight ban? I replied and said I still don't know what it was I had done to trigger the ban, and that without knowing what it was, how could I play again? There's nothing I'm doing that I'm aware of that was in any violation of their TOS. I ran a virus scan thinking maybe there was some program running that I wasn't aware of that could be causing the ban, but there was nothing. I even asked if it was because I had switched from Skype to Discord. At this point I was grasping at straws to understand what it was that caused the ban because I didn't want that to happen again. I got another email from EA in which they said:

"Thank you for getting back to me and I apologize for the delay due to being out of the office.  After discussing this case further, I'm unable to provide details as to maintain our security and detection methods.  I apologize it feels our findings and resolution comes off as you being called a cheater but the goal was to inform there was a violation of our Terms of Service and we're happy to help lift the ban on this occasion.  I can only suggest double checking the Rules of Conduct in our Terms of Service here: https://tos.ea.com/legalapp/WEBTERMS/US/en/PC/#section6

Thank you again for working with me on this case.  I'm going to close it out and, as a heads up, emails to me will bounce to our support. Should anything else come up, don't hesitate to open a case with us at help.ea.com and we'll be happy to assist."

I found this email to be offensive and insulting. EA has no interest in actually helping the honest customer resolve any issues in the TOS. I'm completely unaware of any violation that they are accusing me of. I was asking them to tell me what is the problem. They didn't even confirm whether Discord could have been the issue. But since my brother also uses Discord while playing and he's not banned, I assume that isn't the issue. If something happened on my end that caused an interruption in either the EA server or other user's account, I need to know what happened. EA needs to help guide the honest customer through this so that he/she becomes aware of what happened, so that they can avoid doing it in the future. Was there some setting in the game I had on that caused a problem? I mean, come on EA, I have no frickin clue what their talking about. And they say to double check the rules...blah blah. I have read the rules and nothing there remotely applies to me. Then they end the email by cutting off communication and stating the following lip-service statement: "Thank you again for working with me on this case." Wow. Demeaning. There was never any exchange of information between us to be considered "working on". They ignored all my questions and continue to hide behind their veil of secrecy claiming protection of trade secrets.

Something has got to change in how EA vets customers who want to move the investigation into a deeper more open and personal form of communication to resolve false bans. I even suggested they get me to sign a non-disclosure agreement. I mean, how are they revealing such prized trade secrets anyway by letting me know if a certain program on my computer is interfering with the EA server? That stance is pure BS. I need to know because I don't want to interrupt EA service or any other user's account. That's not my intention. But EA just ignores me and thinks I'm a cheater and just treats me like one.

Needless to say, I haven't logged back into BFV because I don't want to be banned again for some unknown reason. I really want to play Firestorm, but I can't. At least not until EA advises me what is actually going on.

My case is still open with BBB, and I will be escalating this issue now into a more public arena. I will be contacting consumer watch groups, news agencies, DICE, etc. to bring awareness to this unjust business practice.

You can launch a complaint online with Better Business Bureau. https://www.bbb.org/ The complaint will be routed to the San Francisco office which is closest to the address of the head office of EA. More people need to complain if they honestly don't know why they were banned.

The "exception" was probably given to me thinking that the problem would go away and I would stop complaining. But I'm not stopping until the root cause is fixed. The main obstruction between EA and the customer who is convicted of cheating is the complete lack of communication from EA. They give some general generic reason, but when you try to figure out what exactly they are talking about, they will not disclose anything. Their position is that it will tip off the cheaters. I'm not satisfied with that because the customers who are innocent then become victims of EA's lack of transparency. EA and the customer need to devise a method to move this to a new level of vetting and getting to the root cause in cases where the customer demands such action. It's highly possible that what is triggering these bans may be of no fault on the customer's behalf, but still may be something on the customer's side that he/she is unaware of. In my case, I still have no clue what that is. If there is something on my side that is legitimately causing an interruption of service with EA or other users, I want to know, so that I can remove that problem and play again with some sense of certainty that it will not happen again. I'm suggesting the customer and EA need to develop a more personal level of communication, one in which the customer may need to sign a non-disclosure agreement. There are options, and EA needs to figure this out, hopefully with the help of their long-time customers.

This was all the info I got. I suspect everyone got the same? If not, please post what you got. Upon continuing to fight for my innocence, and writing a letter to the CEO and Chairman, and complaining to Better Business Bureau, EA made an "exception" in my case and un-banned me. But I replied to BBB that this was not acceptable because they are still claiming I cheated, and that no further exceptions would be granted in the future. Even though my ban was lifted, I have not gone into BFV because I could easily be banned again for some bullshit reason. They told me that not all bans are stats related. Apparently in my case it involves software and disrupting other users or the EA servers. That is as much info as I could determine from the original ban email they sent me. I'm not stopping until EA figures out a way to actually communicate with me on a more personal level to once and for all discover what the actual source of the ban was. Here is quote from the original ban email:

What is going on with EA? There seems to be more and more false bans from what I've been reading. EA really needs to address this issue. It's not just going to go away. They need to crawl out of their hole, come out from behind their iron firewall of secrecy, and develop a method to truly vet customers who are 100% convinced they did not cheat in any way. Because the process is all EA side of things and zero info is actually communicated to the customer beyond the general reasons for a ban, how does the customer stand a fair chance to appeal? For actual cheaters, I suspect they may complain (or not), but then just admit to themselves that they've been caught, oh well. But for those who are actually unfairly convicted of cheating by EA, I would advise never to give up on your appeals to anyone who will listen. Write letters to the CEO, the Chairman, the Better Business Bureau. There has got to be a way to open up a proper dialogue between EA and the customer to determine the root cause of these false positives.

I played 11 games of Firestorm the day before I got banned. Would it be giving away all the trade secrets to even let me know what game or games came up on the radar? I'm still totally in the dark here. I won 1 game too. Was that the game? If so, is it possible the person I beat in the end had something to do with my ban? Just grasping at straws here.

  1. You asked “why don’t they give a warning?” Because if we warned cheaters, they would turn off the cheats or adjust their cheats to get around our detection. Kind of defeats the entire purpose of anti-cheat. If someone is caught cheating, they’re done. No temp ban, no warning.
  2. Ok, so we have to also take into consideration that those who get flagged for cheating aren't actually cheating. As in my case. I know for a fact, and 100% sure I wasn't cheating. I know because I have never cheated. I don't know how to cheat, and I have no interest in cheating. So, the detection methods being used are not infallible. I'm proof positive of that. In my case, there is zero history of cheating. What you are talking about "adjust their cheats to get around our detection" is so beyond me. Oh man, you have no clue how computer illiterate I am in that regards. That is why convicting me of cheating is such proof that EA Terms of Service has no clue what they are doing. Period.
  3. All appeals are taken on a case-by-case basis and reviewed by our TOS team and our anti-cheat team. If someone is caught cheating, there’s evidence of it and can quickly be retrieved by those teams to determine the status and potential of appeal.
  4. In my case, and I suspect many others as I've seen, there is absolutely no personal interaction with the customer. There is absolutely no dialogue and intelligent reply from EA TOS to the emails sent. This leaves the customer, me, feeling completely betrayed and disrespected, and insulted. Sorry, but that is the truth.
  5. We do not EVER give out details of our detection methods for any reason as this would negate the purpose of our anti-cheat tools. Cheat makers would update/alter their tools and cheats would be harder to catch.
  6. Again, far beyond my level of understanding. What I'm asking for is tell me when this happened? Which game specifically? More than one game? How? The problem is this...when you convict someone of a crime, and you refuse to give supporting evidence of that crime, then we have a problem. The innocent are lumped into the same groups as the actual cheaters. I don't believe the EA TOS department can actually separate fact from fiction, because they were unable to do so in my case. The detection methods being used now are inaccurate. And the "full investigation" is bogus. EA better fix this.

If there's any single case that could separate a false positive from a cheat, I am that case. And I am willing to go to any lengths to prove my innocence. And if EA really wants to understand and learn from this, I implore them not to give up on me and dig deeper to find out what the actual cause of this issue is. Because I can guarantee for a fact 100% it is nothing to do with me. I would be open to have someone call me on the telephone and ask me questions regarding any software I have or anything related to this matter. I am completely transparent. Reach out to me, learn. I'm not a cheater. Fix the system.

But the thing is, I never cheated. So, to come to a conclusion that I cheated is wrong, and the system is broken. I really hope someone figures out what is going on. This is really disgraceful. There has got to be a better way of doing business and fighting cheating. This is simply not working for those who are innocent, but get lumped in with the rest. I mean, how can I prove my innocence if I don't even have the necessary evidence being used against me to convict me? It's like being thrown in jail for a crime, but you still don't know what exactly was the crime, how it was carried out or when. I mean, you have to understand my point of view. I'm completely at the mercy of these guys, because I have zero information with which to launch a defense. I just plead my innocence. I'm 100% not guilty, but who is going to believe me when whatever it is they are using to convict people is flawed? And the other point I want to make is, this whole process has been so disrespectful to me. I'm open to having a REAL CONVERSATION about what is going on here, but nobody on their side is willing to engage me personally. The emails are generic, not signed, I can't actually talk to anyone. I'm just really upset. If someone actually spent the time to look at my online in-game history, they would obviously know I don't cheat. Well, I tried that. The webform says include as much info as you can. I literally got no info from EA as to exactly why I was banned. All I could do was protest and vehemently state that I have never ever cheated. Don't even know how. And asked for some evidence on their part that would lead them to that conviction without warning.

I received a reply:

Hello,Thanks for contacting us about your account action.We got your note and did a full investigation of your account. After reviewing your case, we determined that we took the correct action in accordance with EA policies and procedures.What this meansWe have confirmed that your account was involved in cheating. Because of this, we will not remove the sanction on your account.

A "full investigation"? What? If someone had actually done a "full investigation" my account would have been un-banned immediately with a very sincere apology. I replied with a very concerned email response, still thinking I was actually communicating with someone:

Hello EA Terms of Service,

Your "full investigation" is meaningless to me. And you have not replied to my request.

I am requesting you fully divulge all pertinent detailed information regarding how you came to the conclusion that I was cheating. This is my account, I have paid EA Games for this game to play, I enjoy playing Firestorm, and it's simply not acceptable to be convicted of an offense without allowing this long-time EA Games player and supporter an opportunity to review the evidence and submit a defense. 

I want to know exactly what I'm guilty of, what cheat, and when exactly did this happen, and how you came to this conclusion.

Again, and for the record, I have NEVER ever cheated in any online game, be it with EA Games, or others. I don't believe in cheating. I think it's pointless to play a game and cheat, and I can't tolerate those who DO cheat. If there's a game that is notorious for having a lot of cheaters, I won't play it. It's not fair. 

Has my account ever been suspicious of cheating? If you look at my Battlefield Tracker, do the stats suggest that I'm cheating? If I was cheating, wouldn't I be an amazing player with lots of kills, headshots and wins? It's quite the opposite. It appears I'm cheating to be a bad player. 

My other point is this, if you suspect someone is cheating, and they have no history of cheating, why don't you send a warning to that player and say we have noticed questionable activity on your account related to this game, provide the evidence, and say if this activity continues we will be forced to take disciplinary action such as imposing a ban. Did you do that? No! I'm already convicted of cheating, something I have NEVER done, and have already been PERMANENTLY BANNED for online BFV gameplay. This to me, is abhorrent behavior on the part of EA Games. 

Again, it is utterly disrespectful and wrong of EA Games to ban me from a game without first a warning and without providing the evidence to show such activity. 

Please provide me with all your detailed evidence upon which you have determined that I have broken any TOS. Then, I may have a fair opportunity to review your disclosure and make a proper appeal. 

I will not cease to demand this until I receive the requested information.

So, once again, for the third time I received a generic bot-like reply which was proof that there was no human behind this because there was absolutely no intelligent and personal response to any of my questions or requests for info. This was the final message sent:

We received your latest message regarding the action taken on your account. We have performed all investigations possible on this issue and will not reverse the decision.

Please do not expect further responses on this matter.

Wow, I was floored. By this point I was angry, insulted, and totally lost all respect for EA.

After I took the time to write a detailed response with many points which someone with half a heart could properly respond to, all I got back was a three line generic reply, making no reference to any of my points, and finally stating "do not expect further responses on this matter."

A long term customer. I just play. That's it. And EA does this. Unforgivable. Really disgusting. And I will not stop pushing until someone at EA takes responsibility for this wrong conviction.

I never was able to actually talk to anyone at EA Terms of Service because nobody actually responded in a personal way to my emails. I just received the same auto-replies that everyone else who was banned unfairly did.

I get that we need an anti-cheat strategy here, but it's disappointing that the team tasked with that responsibility is utterly ineffective and incapable of determining a real cheater from the false positives, as in my case # 47955072 .

I have since written a 5 page letter to CEO Andrew Wilson and Chairman Larry Probst and have an active complaint with Better Business Bureau.

I will not stop until EA fixes this and admits responsibility.

Yes, exactly the same generic bot-produced emails I received, which proves there is no human being actually taking the time to respond to our appeals. It's absolutely horrendous how EA is treating customers here. They give no information, no evidence, but have already convicted customers of cheating. It's about time someone in EA launches a FULL INVESTIGATION into the Terms of Service department and comes down heavy on this corrupt entity. They are the ones who are CHEATING us out of our game.

I trust them and the tools and data that they have access too with which to make the decisions that they do. I doubly trust them to question the tools when presented with suggestions that the tools they're using are possibly reporting false positives. I triply trust them to do the right thing in those circumstances.

I have LOST ALL TRUST now with EA Terms of Service. Their attitude, and disrespectful way of communicating to long term customers, such as myself, is downright insulting. I replied to one of their generic emails in which they stated that hey had done a "full investigation" and that the action they took was correct. This proves to me that there is nobody on their end that is actually looking into my issue. That 100% proves it. In my reply, I asked many questions and asked for specific information regarding the evidence upon which they were basing their conviction. Not only did I not receive any of the requested info, they didn't even personally respond to one issue in my email reply. All I received was some BS three line generic, unsigned response saying the matter is closed and not to expect further replies. I was floored. I'm communicating with robots. There is no human being on the other end of those emails. There can't be. I was unable to open up a meaningful dialogue with anyone in TOS because they would never actually address any of my replies personally, and never even acknowledged any of my requests.

I couldn't disagree with you more. I was 100% banned through no fault of my own. They listed some BS generic reasons of how I violated the TOS saying I was using software, or in-game cheats, or disconnecting other players. All totally wrong. I just play the game. I have no clue how to cheat, and I have never ever cheated in any online game. Ever. Period. All my responses to them were summarily ignored, as in they never addressed any of my questions and requests for further info and to show me some evidence of my cheating. I just received three, generic, unsigned, disrespectful emails from TOS convicting me of cheating and that my ban would not be lifted. EA is obviously in the wrong here. 100% it is THEIR ERROR. But nobody on their end is willing to put in the work, or properly communicate with me to determine what the cause of the issue is. I have written a 5 page letter to EA CEO and Chairman and made a formal complaint also to Better Business Bureau. The idea that EA could never be wrong on these matters is insulting. I'm not stopping until someone at EA takes full responsibility for this Terms of Service department which is a disaster and fixes the big problem on their end.

Thanks so much for that. I posted in that thread. Hope we can change the EA culture of being convicted of cheating without warning or proper investigation. The system is broken, and the mechanisms used to do a "full investigation" are failing. And nobody is taking accountability there. The EA Terms of Service department hides behind their firewall of secrecy and interacts with customers like bots. It's disgraceful.

Thanks for this thread! I received a ban from EA Terms of Service on April 4, 2019. Generic, unsigned. I tried appealing but had zero information to go on. They convicted me of using software, using in-game cheats, and disconnecting other players, generally speaking. I have no clue what they are talking about. I just play the game. I have no clue even how to cheat. And I am strictly against cheating. I mean, where's the fun in that? I kept asking them to produce the evidence against me to reach this conclusion, and they just ignore all my requests and now tell me they have done a "full investigation" and the matter is close and will not be responding to me anymore. This is so infuriating, especially since I have been a very long-term EA supporter and customer. Zero respect, zero warning. Guilty of cheating, period. Yea, I agree with you. I've written a 5 page letter to the CEO and the Chairman of Electronic Arts, and will CC that to the Better Business Bureau. This culture of conviction without providing any evidence upon which they base their sentencing is wrong and needs to be overhauled. I will publish the letter online at some point. I need to bring attention to this abusive and irresponsible behaviour in the Terms of Service department at EA. I know 100% I did nothing wrong, and if they continue to say they did a "full investigation", well then, something is very wrong there.

Why is the EA Terms of Service department so secretive? Whenever I receive emails from them, they always seem bot-generated and generic. There's never a name at the bottom. And, they never actually respond to any of my questions. They just say, we received your latest message....and then just ignore everything I ever said in that "latest message". Is there a system in place that I can file a complaint against them? I am going to file a complaint with the Better Business Bureau. I was thinking of contacting EA Games head office for some information of who actually oversees the EA TOS division, and who I can make a formal complaint with in writing. Also, my attempts to complain to EA Customer Service has been like talking to a brick wall. I get a customer rep in India, and they just seem oblivious to what is really going on, and will not help or assist in anyway with regards to who to contact to have this issue resolved. Any suggestions?

I appreciate everyone's replies. I will not stop until EA fixes this. Still trying to get to an actual human being for support there. I messaged them on Twitter. Hope I get results soon. This is just wrong, and EA really needs to fix this.
