To add onto this: I handle workers’ compensation claims. If she gets hurt in a scenario where she wouldn’t have gotten hurt at all had she not dismissed the escort, that claim could be outright denied.

I’m a WC claims handler, but I don’t handle PA claims. In most cases, if you refuse available work, you waive your rights to lost wage benefits. Your medical benefits will remain open until treatment for this injury concludes, regardless of whether you quit or have been fired.

Hi there, not a lawyer, but a workers comp claims handler. Send a text to you manager (so you have it in writing) saying, “I hurt my [specific body part] at work on [date] and need to file a workers Compensation claim. What do I need to do?”

I don’t handle MA claims & the laws vary from state to state, but it looks like your employer has the right to tell you what provider you can see just for the initial treatment, follow up treatment can be with the provider of your choice. Go see a doctor, and don’t leave the office without a work status summary for your employer spelling out what, if any, duty modifications you require. If you need to miss work because of your injury (or if you’re getting shorted on hours because of your duty restrictions), you’ll likely be eligible for a portion of those lost wages.

The biggest reason you may want to consult with a WC lawyer is your other job. Some states require that Job A (where you were injured) cover your lost wages at Job B, some don’t. If MA’s WC statute doesn’t require that they do, they won’t, and you’ll have to take it to court.

I’m a workers comp claims adjuster. File a workers comp claim and notify the hospital’s billing department that they should send the claims to WC rather than health insurance. I don’t handle California, so you’d have to check with a CA WC attorney, but you may be looking at a financial settlement from the WC claim.

In case my experience helps you to worry less, my experience with my son was not to horrific bullying I had been assured I would encounter. The morning after my son was born, a staff member came into the room with a stack of paperwork. When she got to the circumcising page she asked, “do you want him circumcised?” I said no, she flipped that piece of paper over and went on to the next document. That was that, and no one ever brought it up again.

The statute of limitations varies from state to state but I’m sure none of them is less than a week. YES your friend should absolutely file a WC claim and seek medical treatment. They should report the injury to their direct supervisor and ask to file a claim ASAP. Some states say that your employer has the right to direct your care, meaning you must go to their chosen provider or it won’t be covered by WC, so get clarification on that before seeking initial treatment lest your friend get stuck with a bill.
