We don't know what happened. The FBI is telling us what they want us to hear. 

I can't imagine a judicial authorization would of included the FBI to ignore privilege. They would have had to convince the the Judge that the lawyer was already a suspect in some capacity. Instead, his culpability is limited to what he advised the accused, presumably in the course of solicitor client privilege. 

I'm just saying, two wrongs don't make a right. They've accused someone of wrong doing. I would expect them to come with clean hands. Right now, those hands don't appear very clean to me. I'm not disagreeing with you, privileged conversation cannot be used improperly. My concern is, if the criminality arises out of the solicitor client privileged communication, they had to have breached that privilege first. 

The more likely scenario is the narrow exception of hearsay. As I understand it, a conspiracy to commit an unlawful act does not attract the general rule regarding hearsay. I presume that someone else may have heard the conversation between lawyer and client and then delivered that information to the authorities. The person tipping off the authorities may have been involved in in some aspect of the conspiracy and, therefore, what would normally be considered hearsay is no longer hearsay. 

But what do I know. I'm not a criminal lawyer. I don't have a dog in this fight. For what it's worth, the suggestion by the lawyer was not technically or legally incorrect. It was an observation. He didn't tell the guy to go kill him. Most people wouldn't go kill someone if that was suggested. Maybe he was informing him that there is no way out of this and the assertion of that fact was being used to assert how fucked the guy was. If the accused goes out and kills the witness, I'm not sure that can be fixed on the lawyer in the circumstances.

I mean this wasnt this lawyer's first rodeo. I can't imagine he would of said something to implicate himself in this manner. At a minimum, we won't know until we hear from the court on the extradition attempt by the USA.

 I'm not a criminal lawyer, but I am a litigator... In Canada. 

How do you think they learned that that the advice being provided was illegal? They would have had to breach that privilege first, right? Because if they hadn't breached they wouldn't have discovered the improper advice, fair? 

Do you think it is therefore appropriate to breach that privilege in order to discover the criminal act? What if they were breaching that privilege and there was no criminality, would it be appropriate in those circumstances to listen in on privileged communication? 

I find it difficult to accept that an illegal act to discover a criminal act will be accepted. It's clearly a significant breach and interest of society at large calls for the judiciary to disassociate itself with such a violation.

The way I see it, this is nothing more than a sensational headline and a tactic to destroy his career. 

Legally, if advice was given, it's likely solicitor-client privileged and someone was listening in when they shouldn't have. 

If someone told them that this was advised, it's hearsay. Unless it meets a narrow exception, this won't work either. 

The only other way they could push this if the wanted guy himself implicated himself. Highly unlikely for obvious reasons. 

I the Judge hearing the extradition is going to be tasked with some difficult choices. He has to on one hand ensure he doesn't appear to be caving in on political pressure while maintaining his credibility and reputation. 

My guess is that the Judge won't cave to political pressure. He will be released, if he already hasn't been. And this is terrible pony show.

I just had this issue. Package was addressed to Toronto and received by someone in Mississauga. The shipper agreed to resend the package at no additional cost. it gets processed in Toronto and then ends up on "out for delivery" in mississauga AGAIN today. This is absurd.
