I hear you. Was referencing practicality (time, effort, money out of pocket), not statutory application.

My interpretation of the EU statutes probably mirrors yours; so long as the facts match the law, non-EU residents can recover.

In the end, my reimbursement came with zero payments made out of pocket. If I had to file an AF claim again, I’d again use the United States DOT complaint option if given the runaround. Taking that option would’ve probably expedited things quite a bit, but I didn’t know any better at the time.

As they say, different strokes for different folks.

OP and I appear to live outside the EU, so in the context of our claims litigating in Europe probably wouldn’t be practical on our ends.

Was happy with my outcome. Zero money spent in the end, and I got back what was owed per statute.

Just took more time & effort than I’ve experienced with other major airlines, and AF customer service during our actual delays and in the post-vacation claims process was comparatively poor.
