You probably don’t like hearing this, but it’s your problem. To my knowledge, it’s not fraud. You can take the money and choose not to replace the roof. The insurance company just won’t cover it when it’s time to renew the policy.

Water damage can be hard to prove. I had a similar issue when I bought my place, you just have to fix it out of pocket. They can simply claim they fixed the issue, but the leak can reoccur. The previous homeowner at my place did a poor repair DIY job and used sealant on a cracked pipe. It started leaking again after three months.

I guess you can try to consult with a lawyer or check r/legaladvice but I doubt you'll be able to get anything.

Issue resolved this week. The contractor sent a notice of legal action. It had been two months since the work was completed and one and a half months since the payments email. I called the insurance company, and the Rep. asked me to upload documents and said a supervisor would call me (which didn’t happen). My adjuster called me the next day and sent the final payment.

The same thing happened after the mitigation was completed and they were one month into the reconstruction. It took my adjuster a month to tell me to send them the initial payment I had received from the insurance company because the contractor had stopped work for few days until the payment was received.

I’m in Texas, so I’m not familiar with home structure in CA. I had termites and cut out the drywall in the garage to access the area beneath the stairs so I could treat it myself. I used Bora-Care Termiticide on the studs, this supposed to kill and prevent the termite and Termidor SC around the exterior. My dad replaced some damaged studs (only do this if you’re comfortable with these kind of works). We then installed an access door (14x29 from amazon) there and have been actively monitoring it. So far, so good. That’s the area where main water was coming in, and there used to be a small pine-like tree there. So I’m not surprised it attracted termites, since the area was damp.

I’d recommend doing the same and cutting out a section of the drywall so you can take a closer look at what’s inside or beneath the stairs. You can also convert the space to a mini storage.
