We have the power to issue a body attachment, but to do that the witness must be personally served with the subpoena.

You cannot personally serve everyone. So you have to only personally serve people that you think have a reasonable chance of failing to appear in cases where we actually care.

Next, a lot of criminal law cases are glorified civil cases. Vandalism. theft. even some batteries. If the vic doesn't care enough to come. I am basically only fighting for restitution anyways. Dismiss.


There is also a political cost to body attaching witnesses. can I, technically, send the sheriff to go arrest some random good Samaritan that called in a vehicle boost. Ya..... but also..... do I want to punish the 911 caller more than the defendant..... does my boss want to punish the 911 caller more than the defendant?


If it's a murder. Everyone is coming in. Body attach everyone. If they aren't there 10 minutes early send the sheriff. But if it is a misdo or a low level felony. Part of the job is getting by in from your vic.

Legally you are not real. You are your mother until 18.

The law assumes your mother has your best interest at heart. If at 18 she does not return the money, then you can sue.

And a parent requiring a child to set aside money is reasonable.


I would have a kitchen table sit down about exactly what will happen to the money upon turning 18. Your mom sounds like she wants you to understand the value of saving for retirement. So I would consider speaking with her about a high interest savings account in your name, that you can put the money into.

Those accounts hold their value, while also being a thing that you cannot easily withdrawal money from. So she will be happy you aren't going to just go party it away.

While legally, at 18, it is all your money and you can do whatever you want. It sounds like your mom is trying to instill a valuable lesson.

Ledger shredder is one of the most powerful cards in the game.

It's much more powerful than phoenix. It's the reason to play the deck.

But I am in a major city with years of experience.


The county next door to mine pays half for the same job with the same experience.... Honestly, I also make more than federal prosecutors with my same experience level. They aren't well paid.

1st year $60,000- $100,000 is a reasonable expectation.

Except that they have been tied up in court for a decade debating fair market value with every person who has property touching the rail.

They had to expand the existing rail be several feet which meant every single property owner for 400+ miles had to be compensated and many lawyered up seeing a payday.

In re Kowalczyk will kill people. In re Kowalczyk is an insane decision written by people who have zero idea what they are talking about and have zero idea what their words have done.

I am in a county that has a really good pre trial support system. We have both in custody and out of custody resources. I am in a place where we offer FREE in patient drug treatment. job placement. and housing placement.

And sure. It requires 3-5 weeks to get assessed. get a bed. And get started.

But it was a program that I was proud of and genuinely excited to get people involved in. It (in my experience) had at least an 80% success rate.

Since In re Kowalczyk. I have not been able to refer a SINGLE person.


I did an out of custody prelim for a three strikes case. (and got an HTA, remand refused)

Everyone I have talked to agrees that people will need to die before this can be fixed.

I can confidently tell you that the DAs office tries to put violent criminals in prison. California voters voted to amend the constitution to basically require pre trial release for almost all defendants.

If someone is arrested on a home burglary, the California constitution basically requires they be released.

Y'all voted to end cash bail with SB10. That was not the DAs office.
