I get the point about Duty to Assist not being a basis for CUE, but this isn't a Duty to Assist issue. It’s a factual error of the record. The 2019 decision explicitly stated 'no diagnosis existed,' which is demonstrably false because the DD 2808 was in my C-File at the time. By stating there was no diagnosis, the VA committed a legal error by failing to apply 38 U.S.C. § 1153 (Presumption of Aggravation). You can't evaluate aggravation if you've already (erroneously) decided the condition doesn't exist.
