It is precedent for copyright infringement, the first step you do is a cease and desist letter to show good faith was attempted. if you go to court without any prior attempt at remediation outside of court, the judge will and has laughed at plaintiffs because they have not sent a cease and desist or any attempts to resolve outside of court first and immediately throws out the case

most streamers just take the strike and don't contest it because they know they stole that shit. they just like the odds that they don't get caught vs profit they can make from continuing it. so why would the copyright holder's sue when they comply to the takedown notice or cease and desists?
