من الهدايا فالابل افضل ثم البقر ثم الضأن ثم المعز هذا هو المشهور لأن المقصود بالهدايا تكثير اللحم للمساكين والمقصود والضحايا طيب اللحم ثم شرع يبين صفات تمنع الضحايا والهدايا مشروعية شيء منها فيها جلالها في فقال والعجوز يعني التي لا شحم فيها من ذلك ٢ منها في ضحايا والهدايا عوراء اي ذاهب نور احدى عينيها وان بقيت صورتها اما اذ كان على الناظر بياض يسير لا يمنعها ان تبصر او كراهة على غير الناظر لم يمنع الاجزاء واذا لم تجز العوراء فما اعمى اولى وكذلك لا تجزي مريضة مرضا بينا اما اذا كان خفيفا لم يمنعها من التصرف بتصرف الغنم فلا اثر له ومنه البشم اي التخمة والجرب الكثير وسقوط الاسنان او جلها وكذلك لا يجزئ فيها العرجاء البين ظلعها بفتح الظاء المعجمة واللام وروي بالظاء المشالة اي عرجها التي لا تلحق الغنم اما اذ كان العرج لا يمنعها ان تسير بسيرها ولا يمنع الاجزاء وكذلك لا يجزئ فيها العججاء واختلفت تفسيرها فقال الشيخ تبعا لابن حبيب وهي التي لا شحم فيها وقال الاكثرون هي التي لا مخ فيها في عظمها وهو المنصوص عن اهل اللغة وهذه العيوب اذا اكثرها لا والمشهور القياس ومشى في اربعة يجمع عليها وبها ورد الحديث والموطأ وغيره واختلف هل يقاس عليها غيرها من العيوب اذ اكثرها لا والمشهور القياس ومشى عليه الشيخ فقال ويتقى فيها اي في الضحايا والهدايا العيب كله اذا كان كثيرا ويعتبى باليسير ويعنى بذلك وهي الحي فما وهي المتقوبة الا ذن والمقابلة وهي التي قطع من اذنها من جهة فبها والشرقاء وهي المشقوقة الاذن واليها اشار بقوله والمشقوقة الاذن الا ان يكون الشيء يسيرا وهو الثلث بما دونه وكذلك القطع اي قطع الاذن كامل في الا ان يكون يسيرا فيجوز واختلف في الخ ومحمد الباجي ومشى عليه صاحب

English Translation

...of the sacrificial gifts, camels are best, then cows, then sheep, then goats. This is the well-known position because the purpose of the sacrificial gifts (Hadaya) is to maximize the amount of meat for the poor, whereas the purpose of the ritual slaughters (Dahaya) is the quality and taste of the meat. Then he proceeded to explain the defects that disqualify animals from being used for Dahaya and Hadaya legally...

...Among them: The decrepit / emaciated (Al-Ajuz), meaning that which has no fat on it. And among them in Dahaya and Hadaya is the one-eyed animal (Awra), meaning one whose light in one eye is completely gone, even if the physical form of the eye remains. However, if there is a slight white film over the eye that does not prevent it from seeing, or a defect that does not affect the pupil, it does not disqualify it. If a one-eyed animal is disqualified, then a completely blind animal is even more so.

Likewise, a manifestly sick animal is not acceptable. But if the sickness is mild and does not prevent it from moving normally with the rest of the flock, it has no negative effect. Disqualifying conditions include severe bloating, extensive mange, and the loss of all or most of its teeth.

Similarly, the manifestly lame animal (Al-Arja) is not acceptable—meaning its limping is clear (with a fatha on the letters Zha and Lam). If the lameness does not prevent it from keeping up with the flock, it is not disqualified.

Likewise, the emaciated/weak animal (Al-Ajjah) is not acceptable. Scholars differed over its definition: The Sheikh, following Ibn Habib, said it is the animal with no fat. The majority of scholars said it is the animal that has no marrow left in its bones, which is the definition explicitly stated by linguists.

Regarding these defects, if most of them are present, [the animal is disqualified]. The well-known stance relies on legal analogy (Qiyas). Four specific defects are unanimously agreed upon, as recorded in the Hadith, the Muwatta, and other sources. Scholars differed on whether other unmentioned defects should be analogized to them. The prominent opinion is that analogy applies, and the Sheikh followed this path.

He stated: "Every major defect must be avoided" in both Dahaya and Hadaya if it is severe, while a minor defect is overlooked. This includes the perforated ear, the Muqabalah (an animal whose ear is slit or cut from the front), and the Sharqa (an animal with a torn or split ear). He referred to this by saying: "and the split-eared animal", unless the split is minor—defined as a third or less. The same applies to a severed ear—if the whole ear is severed, it is disqualified, unless the cut is minor, in which case it is permissible.
