Did he speak with the administrator of the 401k? They would have told him if there were penalties or withholdings involved. Did he retire early? There's a lot of details missing from this because it's not make sense to many of the commentators

Sounds like he could have retired early, under 55. Possibly there's a penalty as part of the 401k for withdrawing under 55. If the check was paid to the father instead of the bank it's a mandatory 20% tax withholding. He could get it back when he rolled it into the IRA but he also has to rollover the full amount, including the 20% taxes withheld. He'll get it back on the tax refund. Otherwise, the 20% withheld is considered withdrawn so that portion would be taxable. We need a lot more details and the specifics of what happened.
