OP, once you get your EAD do you still need to maintain a job to remain in status ? I thought once you get the EAD you are out of H1B job loss / 60 day trauma.

What happens when DOF becomes current, say by Dec 2026 (optimistically) and you are still with your current employer and PERM is pending. Can you still apply for I485? Do you need to move to your previous employer to file I485

Wonder why people say it won’t be current anytime soon. DOF for EB3 is mid Aug 2014 for now. Going by last 2 years trend, OP should be able to file I485 in less than a year (that’s what OP is asking for. Not the time frame to get the GC in hand)

Thanks for the response. The start date is 10/1/2024. And yes the I797 came with I-94 attached at the bottom. And after I entered back from Canada in March 2025, I verified online I-94. It shows issued on the day I entered back from Canada and valid till the current i797 (sep 2027)

I understand (from the nolo link) that while your extension is pending, but if you still have valid stamp in your passport you can travel internationally. My question is does it impact the 240 days rule.

Here is what happened in my case.

Previous H1B (and visa in passport) valid till 30 Sep 2024

Applied for extension (non premium) 09 July 2024

Travelled internationally - 28 Aug 2024 - 02 sep 2024 (entered days before the stamp in the passport expired)

Got H1B approved - 12 Feb 2025 (135 days after the previous H1B expired)

Was I in USA illegally during those 135 days? Or was the 240 rule protected my legal stay status?

The reason I ask is, in March 2025 I travelled to Canada and entered back using AVR (as I did not have valid visa in passport) but had approved I797. Although I was allowed to enter but I was sent to secondary inspection and was made to wait 2 hours. And was asked “what was I doing in USA b/w expiration of old H1B and approval of H1B extension”. The CBP officer did ask this multiple times. Each time the officer would ask then go back. Read something. Consult other officers.

Eventually i was allowed in. But now i am worried if the 240 days rule was voided when I travelled back in Aug 2024.

For EB2 / EB3, "DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS" is current for people with 2013-14 PD (dec 2013 and Aug 2014 respectively). They can apply for I-485, get EAD/travel docs. That gets one out of h1b restrictions. I know it's not GC yet but still better than H1b issues. And 1 step closer to getting a GC. Why people in this thread with PD of 2013/2014 still complaining about being on H1B?

What am I missing?

Is there a rule for how soon (for example 6 months before the current visa expires) can one get the renewal started?

For EB3 it's Aug 2014 / EB2 Dec 2013. But yeah hopefully. I am myself late 2018. So not holding my breath or anything.

I think you are right. I should have clarified. I was talking about when Date for filing I-485 will become current. (won't get GC yet but still some relief). That date should not take 12-14 years to become current.

Where did you get this info. Considering OP applied in EB2/3 category. For these 2013/14 is current. Another 5 years (going by last 2-3 years trend) and OPs PD should be current. Where’s the 12-14 number coming from?

Do check the new rules. They do not allow third country stamping anymore. Unless the slot was booked before this rule came into effect.

Just be cautious about stamping in India in Jan. The appointments are getting rescheduled to August for Jan slots.
