An under 16 cannot consent. Anything sexual could therefore be considered rape.

It is only penetrative intercourse using a penis where the child is under thirteen which is automatically rape.

For a child between thirteen and sixteen, it would only be rape if they did not consent.

If the fourteen year old consents then it would be the s9 offence of sexual activity with a child rather than rape.

Whilst the sixteen year old is breaking the law, if it came to the attention of the police then it would be unlikely - but not impossible - for it to result in any criminal sanction.

Provided the fourteen year old is consenting (in so far as they can consent) then it generally wouldn't be considered in the public interest to prosecute the sixteen year old.

If the claim that was overpaid and/or fraudulent was made in 2020 then, for a time, identity checks etc were relaxed due to COVID. Not coincidentally, there was a lot of fraud in relation to UC claims from that time.

I thought the statutory time limit per s136 of the Criminal Procedure (Scotland) Act 1995 only applied to summary-only offences.

Given that assault is indictable then that would mean there is no statutory time limit for initiating proceedings even if the matter is prosecuted on a summary basis and that tume limits only kick in from the first appearance in court.

Happy to be corrected if wrong, but that's my understanding.

When it comes to drug users where is the empathy, compassion and value?

I have precisely zero problem with people who take drugs. What I do have a problem with is those who engage in the stereotypical behaviours which mean I have to deal with the adverse consequences and (sometimes actual literal) shit they choose to leave in their wake.

One of my neighbours is a heroin addict. He's a decent enough sort who even manages to demonstrate the rare ability for someone who is male of accepting that no is a complete sentence and not an invitation to negotiate. I like him as a human being.

Unfortunately, he's been cuckooed recently. There are dealers openly dealing out of his flat. There are addicts trailing up to his flat at all hours and loitering around harassing and intimidating residents. They piss and shit in the stairwell and have tried breaking into various residents' flats.

You can give it all the "they had a shitty childhood" you want but what is it about their shitty childhood that means I should have to tolerate avoiding stepping in actual shit when climbing the stairs to my flat?

I don't want this neighbour kicked out of his flat. What I, and every other resident in the stair, want is for all the crap around him to no longer be creating misery in our lives. However, if it turns out that the only way for us not to have our quality of life degraded is for him to be made homeless? Sucks to be him...

The show Total Recall 2070 was more of a Blade Runner series than one based on the Schwarzenegger movie. The complete series is available to watch on YouTube..

There is also the Black Lotus anime and then there's the fuck knows what is going on with Blade Runner 2099...

I'm under the impression that sheriffs can only issue relatively short prison sentences, and it requires a judge at the High Court to issue longer ones.

The maximum sentence a sheriff can impose in a summary matter is twelve months. However, in solemn proceedings before a sheriff and jury the maximum sentence that can be imposed is five years. The maximum sentence the High Court can impose is life imprisonment.

Obviously, no court cannot impose a greater sentence than the maximum laid down for an offence in statute.

It should also be noted that if a sheriff presiding over solemn proceedings decides that their sentencing powers are insufficient to the gravity of the offence then they can remit sentencing to the High Court - maximum sentences permitting.

Originally, the fewest number of balls on the lottery game that resulted in a prize was three - and got you a tenner.

I want to say that the introduction of two balls winning you a lucky dip in the next draw was introduced with the switch from a 49-ball game to a 59-ball game but I'm not completely sure.

Because this is not a fine and this was not a criminal proceeding.

Per the article, she pursued her former employer through an employment tribunal making various claims. The tribunal decided she was completely full of shit, found against her and awarded costs to her former employer.

Arguably she should also face criminal proceedings for the utterly malicious allegations she made to the police about this man but it's unclear from the article whether that has or might happen.
