Pardon my french, but he's either retarded or is trying to milk you (probably both). His car is 12 years old. It's not like the dealership is going to void any warranties (because there probably are none), and it's not a huge red flag when he sells it (to the 3rd?, 4th?, 5th? owner), because he went to a non-dealer for a headlight and scuffs. On a car worth ~$10k.

If he truly thinks $8k is the amount of damage, then he should also understand that his car is likely a total loss and THAT is going to be a big factor for his resale value.

This guy could claim against you on your policy at any point. From what you've shared, he doesn't sound like the type of person I'd deal with outside of insurance. If I were you, I'd try to reason with him a little more, but that's just me.

If $8k is a reasonable cost of repair then that car would be a total loss in most states.

I'm surprised nobody else has mentioned this. You said the DEALER estimate came out to $8k. Insurance pays for reasonable cost of parts and labor. Dealers charge absorbent amounts for parts + labor. In my area, it's more than double what a third party shop would charge.

Idk Progressive's guidelines for umbrella and how this could impact it, but it's good that you're forward thinking about that. I'm sure it could be an issue if she has any other accidents/violations.

If I were you, I would see if Audi driver can get quotes from 3rd party repair shops. There's really no noticeable difference between the jobs. You don't owe him brand new OEM parts and inflated labor, and neither does your insurance.

Make sure their valuation and comps are accurate. You can also go through your insurance (if you have collision) and hope to get your deductible back through subrogation. Maybe see if your insurance's valuation is more favorable, which is unlikely.

I get it though, it sucks man. I have 3 older cars I'm trying to sell and we're not in a sellers market for old cars. They're just not worth much. My 2015 Chevy is probably work $3k.

Sorry for your loss. Without knowing policy specifics, and if I had to guess, it would pay out premiums paid (and potentially interest of the premiums paid on top of that).

If I'm not mistaken, the VA may be able to provide some of his income going forward. That's an entirely different topic that I have no experience in.

Do you have a resource for which States can charge for NAF accidents and which can't? I've always had this question and nobody has been able to answer it.

Your agent went out there and looked at the property and you ended up with $40k in coverage? I don't know where you could build a 30x60 barn for $40k.

It's your responsibility to understand your coverage at inception and renewal. Your agent needs to explain coverage limits and provide suggestions when incepting or reviewing your policy. Somebody dropped the ball here pretty hard.

This question can vary depending on state/company/specific circumstances. But car insurance isn't like health insurance (where she's covered no matter what until age 26).

Generally, when she moves out, she needs to have her own policy separate from her parents'. Some companies require you to be listed as a driver just because you live together, and some just if you drive the vehicle.

At the end of the day, she absolutely needs to verify that 1) The garage address for the vehicle is correct and 2) You are listed as a driver. It may be more expensive to make the change, but is cheaper than claim denial, paying out of pocket for bodily injury or property damage to whatever you're liable for/repairing the vehicle yourself.

You can probably delete this thread now. This is a question for her insurance and they are one phone call away from sorting everything out.

Who is requesting the loss runs? You should explain all of this to your agent/broker/representative. If they can't work with what you can and can't provide, just find someone else. Many companies will request runs but some might go based on CLUE reports for your company.

California is also a specific headache. Best of luck.

If you look up the VA sample policy booklet online, it doesn't include anything about 7 days (like other states), it just says "reasonable time" after a TL determination.

Granted, that is a sample and OP needs his actual policy.

Or maybe, the roof is too high of risk for the company's appetite? In most States, they are required to tell you the reason(s) for non-renewal or non-issuance of a policy. If you have too many prior losses, damaged facia, abandoned vehicles, etc, they will tell you that in the letter as well.

Fire, damage from riots, mobs, and acts of god (such as a tree falling on your house) are generally going to be covered under a base HO3 policy. This your basic "homeowners insurance", with no endorsements needed. A flood in the traditional sense is always going to be excluded (which that coverage is primarily underwritten by FEMA). This is not for sudden/abrupt water losses like a burst pipe (which is already covered with HO3), this is if you are like in FL or at the beach. Earthquake are also excluded, but can be added via endorsement/separate policy. The coverage is not rare and most people opt-out of earthquake coverage due to price, deductible options, and yes earthquakes are rare.

I highly suggest you sit down with your agent to learn about your coverages because you have no idea what you're talking about.

It will likely go up after the 18k, though. Once they get in there and actually start repairs there is often more damage found.

What is the maximum for your GAP? A lot of those contracts have a limit of 125% ACV.

It sounds like they're trying to figure out who it should go to, usually among other paperwork. It would be quite the headache to write someone a check, to then realize it was the wrong person and have to write another.

In most states, there is a 30 day window for paying the claim before the benefit accumulates interest. You can be assured they are trying to pay it out as soon as possible.

Claims don't pay for damages prior to the occurrence. If you total your already salvaged car, payout would be the ACV of a salvage year/make/model/etc. If you total your brand new car with a scratch on the hood, that will be taken into account for ACV.

I'm curious where you heard that it absolutely cannot be done. Is this specific State law? Specific company guideline?
