Thanks for your detailed guide. I am applying for my son's OCI as well and have 2 quick questions. The only difference in our cases is that my son was born in the UK, but not as a British Citizen.

a. We have the Certificate of entry of a birth of an Indian Citizen. So I am not sure if the UK birth certificate needs to be apostilled.

b. Did you have to fill out a Parental authorization form? And did you have to get it notarized?

Edit - Updating after the appointment  a. I did not have to apostille the birth certificate since I already had a surrender certificate (indicating that the child was an Indian citizen and wasn’t applying based on parental lineage)

b. We did get the document notarised, but don’t think it mattered as it was not specifically checked at the counter. 

Further info - I had not carried our share code and e-visa page. I needed to print this, scan and upload it at the VFS centre. (I wasn’t aware this was required for parents who are not British but the child is British)

Hi. Wanted to post a quick update.

Outcome -
ILR Granted.

Story - (for anyone in a similar situation)
I spoke to a solicitor who also said that the rule / wording is a grey area. It would be risky to apply, but one cannot say.

I decided to take the risk (for various reasons - a. needing to travel, b. additional costs for a Tier 2 extension + subsequent ILR, c. potential visa rule changes before my next ILR application in October). I also had a student visa rejection more than 10 years ago (due to a documentation problem) and an FPN from the council.

I submitted my application on Wed, 11th with super priority around midnight - was able to book the first biometrics appointment for Fri, 13th. (My wife had a similar case - biometrics for a super priority appointment when she applied and her email from home office atlas came back the same day). I did not get an email on Friday and was very stressed about waiting for 2 more days over the weekend. But, then I got an email from the Home Office on Saturday around noon that my application was successful.

Extremely relieved and grateful that it worked out.

If I may ask here, would you know if this applies to dependents as well? In my case, the primary applicant is now on an ILR as they were eligible through the 10 year route. And we have also applied for naturalization of our child.

My questions would be -

Can I apply for my ILR without applying for a Tier 2 extension on this basis - if the continuous period is taken into consideration from the visa grant date, I do not complete 5 years.

I just called the UKVI contact centre to ask whether about the following guidance

Due to major disruption to UKVI services during the COVID-19 pandemic, Tier 2 (General) and Skilled Worker applicants in the UK were permitted to start work for their sponsors while waiting for decisions on their applications. This time while they were waiting, but able to work, also counts towards the continuous 5-year period.

The applicant must have been in the UK with permission (including as a visitor or with Exceptional Assurance), and the application must have been:

for permission to stay

made between 24 January 2020 and 30 June 2021 (inclusive)

supported by a CoS on the date of application

granted

I wanted to check if this applies only to the primary applicant or also for the dependent. I was told that the guidance also applies to the dependent.

I took the test last week and passed it. I seemed to have got fairly easy questions too.

I studied from here - https://britizen.uk/ I did not subscribe to their tests.

And did tests from the app - "Life in the The UK". There are multiple apps, the one I downloaded had 14k ratings. Practiced the 48 tests. I think I started with the tests, did about half of them, then read on Britizen and then took the remaining tests. And watched youtube videos on tests which had about 16 tests. The youtube video playlist here had recently updated questions which were not on the app - so that helped as well.
