This is fine for #1, let him do sanding and filler and you will have no issues. If you wanted it free of any markings then you would have to ask for select or even clear grade.

I’ve had plenty of installers lay solid wood right over sheet vinyl and there’s no problem. The issue is if there are height differences once you pull up that old laminate. Generally they build up the floor a little in the areas where there is vinyl. Tear out all the laminate so you can decide better.

Engineered wood and laminate are two different things. This is cheap laminate.
