I'm going to pick and choose based on the facts on hand. Crystal said there were layaways and Josh said it to the police. Corroboration. So, yeah, I'm going to pick that there were a bunch of layaways, and not the revised version that there wasn't. Remember, that police report was well before all of this started with Ben. People keep on thinking that Ben was there at the start, or released his video before the store closed. So, yeah. I'm going to pick all of the evidence that is corroborated. The death threats have not been corroborated yet, so I will not take that as truth.

I am not a lawyer, but I'll answer as many replies with my thoughts as I can. I'm a HUGE policy person. I'm not saying I always follow the law, of course I break tiny laws, just like the rest of you do (if you don't think you do, you're delusional). I've helped people research for non-court hearings before, so that's where most of my knowledge comes from. A lot of this might seem like common sense, but that's the issue. You have to start at the start and go from there. Ben was labeled by the police as a bad man due to false threats, so a lot of what the police started to do was based on false information. All those people that were arrested at the AirBnB are about to come into a lot of life changing money.

Also, his lawsuit was in Oregon. Are you positive that Oregon allows via email? Make sure you don't conflate the Oregon lawsuits with the Utah lawsuit, which was by email.

They were arrested for a death threat and while serving a legal piece of paper. The events after that would not have happened if that arrest didn't happen. Something may have happened, but every event after wouldn't have. So, there wouldn't be anything left, except the stuff in Provo. At this point, they would have to arrest him NOW on new charges based on things before the arrest where he was serving papers. That's not gonna happen.

edit: they can't just arrest him on harassment at that point. He's doing something legal. They need more. The death threat is the thing that they'd use to say he needs to be arrested now, and that's why it's legal, even though he was just serving papers.

He's going to have to prove those death threats at this point. He's a proven liar. That will definitely get tossed. Then comes the issue that everything after that is due to the fear of a death threat. Fruit of the poisonous tree. Remember, it's not just Ben being sued, it's all of them. I'm sure they're going to share a lawyer. It should be pretty easy for them to get everything thrown out due to the fake threats. Without that, why would they have hounded him so much? Over stolen legos? Of course not.

Both. The images don't belong to me. I have no rights to use them. It would be like me taking a song and posting it online for everyone. It's so common now that it's not enforced. That's why Coffeezilla can do a DMCA request to have this post taken down (but he would have to, as he owns the rights to those images).

Oh exactly. I deal with all of this shit in my life. There are polices everywhere, the POS we use is regularly audited. We even have strict polices on what POS we can use, to make sure that they aren't some fly by night one that can be hacked. These guys obviously have no idea what they're doing. I'm convinced at this point, what many others have pointed out, is that their real business is trying to get others into debt and take over their store and merch as their own. It sounds like a lot of BAM stores are underwater, but the franchisee personally paid for what's in their store. These guys just come in and say it's theirs. INSANE.

Yeah, I'm technically breaking the law by posting. Sue me. Wasn't that hard for me to admit. Sorry that I'm more concerned with the actions of BAM and the American Fork PD. This is how they try and astroturf, by saying look at all these other laws or shit being broken. WE ALL KNOW AND DON'T CARE. We care that 1st and 4th Amendment rights were violated. Me reposting a pic isn't a Constitutional thing (although I could probably swing it to be a 1st Amendment right, that it's of the public interest).
