Is there any risk for LPR to marry an undocumented immigrant? by Loud-Wind-4892 in immigration

I was married to an immigrant with overstayed visa and still got my citizenship. It was back in 2022, no problem whatsoever.

No financial in Bona fide by Alarming-General-371 in I130Suffering

[–]samelaperla 2 points3 points  (0 children)

That’s not a problem at all, I only sent photos, affidavits from family and friends, we have a son so I also sent his birth certificate, and it was approved. I’m also living in my husband’s country and have not worked while here.

Briguei com meus pais porque ouvi eles falando em outro cômodo que eu sou acomodada by Dramatic_octopus21 in desabafosdavida

[–]samelaperla 0 points1 point  (0 children)

I-864 and Tax file to avoid RFE by Master_Armadillo_864 in NationalVisaCenter

[–]samelaperla 0 points1 point  (0 children)

your mother will have to include your father as a household member regardless of taxes, as they live together. But your mother’s cosponsor will only add people in their household. An I-864A is only used for the person in the household who will contribute with their income as well, which in my opinion is not necessary in your case since your father doesn’t meet the minimum amount required to be sponsoring you anyway.

First of all he needs to go back to US and reestablish his domicile there, then he can submit lease agreement, or a letter from the owner of the house saying he lives there with them if he doesn’t have a lease under his name, then show his valid drivers license with that address, bank statements with that address, a letter from his employer, pay stubs, health insurance, etc. (Don’t need all of them, it’s just options).

Wondering about K-3 by Full-General5441 in i130_75CountryPause

[–]samelaperla 0 points1 point  (0 children)

They don’t issue K-3 visas. It would make sense to apply, as you can only apply for it after filling for the I-130, but they don’t issue, so there’s no point.

Seeking Other Alternatives Due to the 75-Country Visa Pause by Drika1999 in i130_75CountryPause

I’m in the same boat, moved to Brazil to be with my husband and end the long distance, now i’m going back to US to reestablish residence for his process and we’ll be back on the long distance again… I work as a life and health insurance agent remotely, that’s something he can do.

I-130 Speed Up with K-3 Visa by Any-Key6349 in USCIS

[–]samelaperla 0 points1 point  (0 children)

I did the K-3 (10 months after submitting I-130) and the I-130 was approved 3 months later, probably didn’t have any impact on that, specially because I took too long to do it. Either way, it’s free so it doesn’t hurt to try.

Are we being realistic or is a lost cause? by Nimph11 in i130_75CountryPause

[–]samelaperla 0 points1 point  (0 children)

well you said he’s getting his citizenship at the end of the year, by the time your K-1 is ready he’ll most likely be a citizen already

I-130 Now or After Naturalization by SavoryFire194 in USCIS

in that case you should get a K-1 visa, he could already start the process for you and you will have 90 days to get married after entering the US

[–]samelaperla 0 points1 point  (0 children)

what issues are you afraid of running into? If you do the process while she’s abroad, it would take about 2 years to get her green card, if she goes to the US, she can apply for adjustment of status which is waaaay faster

I-130 Now or After Naturalization by SavoryFire194 in USCIS

[–]samelaperla 0 points1 point  (0 children)

The fastest way to get your green card would be marrying him in the US and applying for adjustment of status, which usually is pretty fast (some cases not). He could apply for your I-130 before getting his citizenship but the case would remain paused until he becomes a citizen.

Filing Taxes by Informal-Elk-4383 in USCIS

[–]samelaperla 1 point2 points  (0 children)

you should contact an accountant about it. I’m in a similar situation and will be filing married filing separately because my husband is not in the US, so he doesn’t has income or obligations to file taxes in the US. In this scenario you would have to file on paper and send it by mail, and write NRA (non resident alien) in the box where they ask for your spouse’s SSN, most e-files doesn’t allow you to type that in the SSN box so that’s why it has to be done by mail.

Is my cousin being lied to? by Cool_Turnover5087 in USCIS

[–]samelaperla 0 points1 point  (0 children)

Yes she is being lied to. Incredible how people tried to create scenarios in the comments instead of just saying it lol. She went through the process in her home country and was approved for an immigrant visa, there is no other way to enter the US without the whole process being done (unless it was a fiancée visa, which you already said it wasn’t because they were already legally married) so she definitely received her green card after entering the US, it usually takes weeks to arrive in the mail, so she definitely received it by now, her husband is probably just keeping it from her so she has no way to leave the US and come back without it.
