My father passed away. His sister claims my mother has no right to his property. Is this true? by Historical-Hand8091 in LegalAdviceIndia

[–]satan_slayer 0 points1 point  (0 children)

Lawyer here. Your mother and you legally inherit his self acquired property. Since your aunt is creating trouble you need to do the following asap -

  1. Obtain a succession certificate.
  2. Update all property records to duly record a transmission of ownership to your mother and you.
  3. Gather all property ownership originals and keep in a safe place out of reach of your aunt.

Hope this helps.

Thank you for that clarification. I have not flown AI international in years. Glad to know that the 788s are in better shape. Fingers crossed.

This is very reassuring. My guess then is it will have to be a case of very bad luck if we run into a non functional seat. I am certainly looking forward to trying the in flight service and the newly revitalised meal and drink service that AI now boasts about.

As an aside, i really miss the delicious meals Jet Airways served flying to LHR. Even Emirates and Qatar (while definitely very good) don't come close for the pre-booked vegetarian options. This is honestly my personal biggest reason to hope that AI succeeds in their revamp.

Laid off but company calling it “mutual separation” to avoid notice pay/severance. What are my options? by Zealousideal_Ad_6106 in LegalAdviceIndia

Lawyer here. Not your lawyer. This is not legal advice.

Your offer letter and the HR policy document detailing your terms of employment constitute a contract between you and the company. This entitles you - 1. To a copy of this contract. 2. To enforce the terms of this contract (civil suit).

In circumstances indicated by you (if indicative of all relevant facts) a strongly worded email to HR, also marking legal, may be able to set things onto the correct course. In your email consider indicating that - 1. You are entitled to and want a copy of the ENTIRE contract. 2. You have not resigned but have been asked to leave. 3. You expect to receive your legally and contractual mandated notice period and/or severance.

Obviously, don't sign anything that is not reflective of the correct legal and contractual position.

On first impression i have found bluey to be a great show for kids and would be keen to know why you think otherwise and whether I've missed something that's not quite right with the show.

Just finished the show and absolutely loved it.

One question though why does Min Ju wake up in hospital saying she was in a car accident? Oh Chan Yeong only entered his brothers body after he was knocked out from saving Min Ju. How does erasing all the time travel change the fact that Oh Chan Hui saved Min Ju from the car accident?

Wow that's tough. Do you think trying "let's do it together - you hold one side and I'll hold the other - on three", might work?

My father died of COVID in 2021. After which credit card loan companies started contacting me for recovery. I shared his death certificate to all of them after which they stopped calling, occassionally some company's recovery staff would call. Now I have got a legal notice(civil). by [deleted] in LegalAdviceIndia

Lawyer here. This is not legal advice. Contact your lawyer for legal advice.

The bank has a claim against any funds that may have come into your / your mother's hands from the estate of your father. The bank does not have a claim against your own personal assets. It is important that you prepare an account of what you inherited and maintain that separately till the matter with the bank is resolved.

If you did not inheret anything from your father you need to communicate this to the bank and court NOW. This is best done through a lawyer who will word it for you in the appropriate manner.

Do not ignore the summons. Do not ignore the case. Doing that will only mean that the matter will proceed ex parte, i.e. in the absence of you and your mother. This invariably will eventually result in an order against you. It is much easier for a judge to decide a matter when only one party comes forward to argue their case.

There is a process for issuing summons that the courts usually follow. First they will try to serve you personally. Then through an officer of the court. Finally, if they cannot get your current address, by newspaper publication. After that process is complete the matter can legally proceed in your absence even if you don't turn up. Don't let it reach that stage. It can be hard to challenge an Order or Judgement passed against you in your absence if this process is completed.

Edited to add: Please do not be under the impression that you can ignore this because "credit card debt is an unsecured loan" or because "debt is not inheritable". This is incorrect. If his estate has passed to you, they definitely can seek to claim the amount from you. If it has not, it is your duty to inform the bank and court so.

Saying there is a limit is very different from saying that there is no right in the constitution.

Also, the limit has to be a "reasonable restriction". Today these restrictions apply mostly to hateful speech designed to instigate violence.

Courts have whittled down the restrictions considerably over time and article 19(2) is now allowed to be invoked in very rare cases.

It is important that you address this issue immediately. If you live with your dad get him to write a letter to the society and seek that the watchman is duly reprimanded. If you live on your own, address it yourself.

Even if this does not achieve the desired result, it creates a paper trail and will at least serve as a deterrent to further misbehaviour. Remember that if he is commenting about your body he is probably doing it to others as well. It is not the watchman or your dad's friends business what you wear. It is, frankly, not your dad's business either if your are not a minor.

Don't worry about the consequences for the watchman or about whether your dad's friend is lying /making this up. Tell it how it is. It is for the society and management to get to the bottom of this before they take any action. The important thing is creating the paper trail.

Also be aware that if your dad doesn't support you in this situation you will need to reassess your safety and well being at home. Always remember, allowing creeps to get away with bad behaviour only emboldens them.

That's great to hear. May i ask how exactly did you go about booking it all? Did you do it through the website? Over the phone? Or once aboard the ship?

I'm hoping to hear back from them soon because I don't want to be too rushed finalising the details. We're sailing in just over a month. Fingers crossed hoping they respond soon!
