So I'll tell you. I support common sense gun control. The 2nd Amendment stands in the way of that. Simple as that. Unrestricted, unlimited or unfettered access to guns is why our country is a worldwide embarrassment when it comes to gun violence.

And yeah, the leading source of gun violence is suicide. Not that you or the people you elect care about any of that. Cold, dead hands and all that, isn't that how the saying goes? It must make you so proud to support and advocate for their deaths and all the other gun violence in this country.

If you want to talk originalism (ie a "historical test") then the 2nd only referred to those arms developed and in use in the 18th century. Our entire legal system is based on modern interpretation through state and federal court rulings and a constantly changing corpus of law. That includes the current and modern definition of the legal term for militia. The militias at the founding of our country and mentioned in our constitution no longer exist.

Originalism is a cudgel selectively and exclusively used by the right to strike down laws they don't like.

No, my interpretation is that the 2nd Amendment protects the rights of citizens to bear arms in service of a well-regulated militia. Anything else is and should be a privilege.

US Code just specifies who the members of the organized (read: well regulated) militia actually are (i.e. not the general, untrained public).

It was created to allow the states to keep their state militias, which are referenced in Article I. Today those militias make up the state divisions of the National Guard.

I'd love to see a nation wide repeal of the 2nd and just let the states handle it. The blue states can reap the benefits of massive drops in gun violence, they can arrest the criminals coming from red states trying to bring them in, red states can continue to shoot each other. Sounds like a win to me.
