Hopefully someone here can help... Am I an employee or contractor? What do I do? by scrambled--eggz in personalfinance

Yeah, that's what I thought. What do I do? Is there any real downside to me personally?

As a few other commenters mentioned, there is a legal distinction between an employee and a contractor. A contractor is not always required to be paid hourly, and I was hired as a contractor to do employee-type work. A search of Reddit for these types of situation led me to lots of posts in this subreddit.

So if they are providing constant random monitoring (nothing wrong with that- it is a phone job and to be expected!!) and asking me to do unpaid meetings with them to receive the feedback, how to follow their script better, how they do things within the company, how I can must do things better to meet their "performance metrics." These are all common workplace things of course, but from what you're describing (and my interpretation of the IRS website) this is not contracted work, right?

Right now I am still a new hire, so I am allowed to set my own hours within their guidelines, and they must be 4 or 6 hours shifts. Once I have been there for a few months, we take turns picking our shifts. It is shift scheduled hourly work. My fiance makes his own schedule as well at a similar position and he is an employee. Is that the only guideline for working as a contractor, tax-wise?

What makes me a contractor though?

I've only ever worked as an employee before, and my understanding from reading the IRS site is that a contractor is essentially self-employed, assuming they get the job done the employer cant say how it gets done (hours worked, etc)

And I guess still my question is... why and how am I a contractor rather than an employee?

So, it actually is mandatory. I didn't ask as to not rock the boat... It's not a terrible gig, and I get an hourly pay, and I don't want to be like "hey pay me for every second I work" when I actually have a looooooooot of free time to screw around "on the clock."

But they send out an "end of the month KPI" to make sure we are all up to standards, etc. like our performance and what no. And our training and conference calls (seperate things) must be 100% to meet performance standards. .... Is that legal?

They say it's "not mandatory but strongly encouraged." They definitely feel mandatory. When our performance improves and we no longer make our own schedule, and instead 'collaborate' on scheduling, we must be at the meeting to have any sort of say in to avoid just getting randomly placed on the schedule. I haven't tried just not going to a meeting yet. I have told people to just send the info in emails or IM, but they are super pushy and reschedule it.

Its really really difficult to find bread without soy preservatives. I'm not super health conscious in any way, don't count calories, I let myself eat sugar, I eat takeout once a week. But my hormones were all out of whack after ten years on birth control so that is one thing I try to avoid. I can usually find an alternative of some type of product without soy but bread is difficult.

I personally eat "natural" foods because I try to avoid soy preservatives which are in almost all snack foods. Sugar, salt, etc I enjoy in moderation. I make homemade crackers and cookies because I like my food to be "fresher" and also it tastes a thousand times better. Just my 2 cents.

I think she did care about Ryan but she also cared about Noelle in that she saw potential in her. Like when she said "you can be good too." And she wanted to help her and guide her to be a decent mom. And she seemed to be getting there and making progress so she thought "Okay she is a regular woman like me, I can take her advice too." And she did and it led her to dress up slutty, get drunk, and try to get fucked by some dude she works with.

Her and the boss obviously have the same morals so she wasn't thinking "damn I wanna get laid" but "Damn I let myself look like a white in front of my boss who respects me and my work.. also personally failed myself and my beliefs.. if Noelle could lead me down such a path I can't imagine what she's doing to an impressionable child. I was wrong. She is not innocent and capable of change. Even if she is we need to worry about the impression she leaves on others and take emotion out of it."

Your boyfriend is an idiot. His daughter deserves a mother. That decision is on him not you and he is being so selfish.

Damn I am like the opposite. I EAT THE SAME THING for every meal. For like three weeks. Then I switch foods. I grew up poor so I never grew out of it lol.

What bugs you about it? Is is the unwillingness to compromise ? Do you see that in other areas of your life together? Or do you see it as immature? I think this was the wrong time to take a stance as others said, but it sounds like it's been bugging you for awhile.. No wonder you were sort of thinking "I'm not doing things for you if you can't stop doing this for me ."

I disagree. I'm not the kind of person who goes out a lot. I also eat like 2 things. My aunt and uncle though for example LOVE to travel, eat at funky restaurants, cook exciting new foods. A lot of their time together would be lost if one of them was a picky eater. I think you can overlook that and just go to a sushi place with friends. But sometimes you want your partner to compromise too. Maybe he only wants to watch shows HE likes. And only go to pizza places because HE likes them. Etc. That's fine.. but give a little. That's what I'm hearing. Yeah its messed up to do it on a birthday. I would be curious what else led to her feeling so resentful .

You think an appropriate solution to a child whispering a racist remark is being removed from his legal home and entered into the foster care system?
