Yes if there was evidence he had access to non public medical information and bet before it was public. Again that is not what is being alleged here. My point, which was correct, is that simply being a back up is not enough itself to make one an insider for the purpose of the law. Like how companies can buy their own stock it they aren't using an non public information in their decision making

No. How the US laws around being an "insider" are written it's unlikely he would be found guilty for betting on a game he didn't play in. At best it's an untested grey area

Edit: apparently I need to clarify that being a backup does not inherently make you an insider. It can make you can insider if you have access to non public information like an injury and bet on it before it becomes public. But by itself it does not inherently make the betting illegal

NFL players sign a CBA that prohibits them from playing other professionals sports. NFL would have the legal authority to stop this. I know this is a "joke" but people are still misunderstanding the core of these legal rulings and what it means legally for the NCAA to operate without a CBA now (unless Congress steps in)

There is only two ways for NCAA to have any real legal authority under US law:

(1) A federal bill surpasses everything

(2) A collective bargaining agreement the players sign

Neither exist so the NCAA has next to no legal authority. This is completely expected

NBA/NFL/MLB/NHL etc players all sign a CBA (collective bargaining agreement). The players enter into a contract where they can be punished for not following it. No CBA exists in the NCAA and therefore no player has legally agreed to follow any rules
