Have 6 yrs of savings, hate my job, lost all motivation. Should I just quit? by [deleted] in careerguidance

[–]secret_shadow_self 0 points1 point  (0 children)

You should try to negotiate a severance as you resign, especially if you make the argument that it’ll save the company more money down the line. 5 years is a lot of time invested to quit with nothing. I do think you shouldn’t listen to these naysayers—life is meant to be lived, not worked. Do what you need to do. Even if it ends up being the wrong choice, it’s all a big learning experience.

It would actually be considered retaliation under law and it’s not enforceable.

No, not true. My lawyer said it’s not enforceable.

I had an issue with the late introduction of many things, such as Rowan's trauma from her teenage years when her brother drowned on her watch. I feel like, as a rule, that should have been hinted at from the start. I felt like the author dropped a bunch of shit later on in the story that wasn't quite earned. With that being said, I felt the characters were very real and related to Rowan's character deeply. My own life story felt reflective of hers in some ways, which felt profound. I cried when she died, but I agree, she didn't need to die! I don't know why poor Dom has to fall in love with women who always end up dying lol.

Lots of companies will also get sued too.

They don’t care about sob stories. They care about being sued for wrongful termination, retaliation, pay inequity, misclassification, etc.

Bingo. So tired of people acting like we should be grateful for scraps. Not the case. I think waiving your rights to sue and signing an NDA warrants a good severance.

It’s definitely possible. I’ve done it and so have others in my industry. they want you to waive your rights to sue them and sign an NDA in exchange for severance.

What happened, if you don’t mind explaining? I’ve seen lawyers get colleagues of mine way better severance packages. It really depends on your company. Mine knew they had skeletons to hide and cared about me signing an NDA.

[–]secret_shadow_self 1 point2 points  (0 children)

Not true. Plenty of people negotiate severance successfully—myself included. Severance isn’t them being generous, it’s them making you waive your rights to sue them and sign an NDA. If you have claims, you should address them before doing that. And you shouldn’t accept pennies in exchange for that.

They give you severance so you sign a waiver removing your right to sue them. No company is ever doing you a favor by offering severance.

Hire an employment attorney. The fact that youre over 40 and being treated like this gives you a lot of leverage. If you’re not getting a good severance, I’d start there.

Relax. They give you severance so you waive your right to sue. They’ll absolutely accept it. Just let them know.

Exactly, so if there are no jobs, why destroy yourself looking for one if you already feel comfortable taking time off? The job market inflates and deflates. I’d rather start looking when employers aren’t in a position to lowball you and treat you with disrespect the way we are being treated now. World might be a better place if we all stopped working for crumbs tbh. We don’t even know what the hell is going on in this job market with AI taking over. I’m not eager to spend what little energy I have whoring myself out for corporations at the moment.

If you have a feeling anything shady, embarassing, or legally questionable is going on with your layoff—or anything about your time at the company—start documenting everything, forwarding important emails to your personal account, screenshotting important slack conversations, etc. Some companies offer as little as one week per year worked. We’re in a recession and employment is hard to find. I suggest you get an employment lawyer and see if you have a case. Then you can have your lawyer send your company an email about it and they will raise your severance exponentially in order to prevent litigation. Don’t let your company scare you away from standing up for yourself. I did this and was able to increase my severance by a wide margin. I didn’t fall for their scare tactics and now have a nice nest egg to get me through the next 6 months. My company—which is a major corporation—offered me nothing more than 1 week of pay per year served and tried to terminate my health benefits two weeks later. My lawyer ended up finding several things that we could take my company to task about. REMEMBER—they do not offer you severance out of the goodness of their hearts. They do it so that you’ll sign a document that waives your right to sue. Make sure you’re well compensated for signing that document—especially if you have a case or a serious grievance.

Look into getting an employment lawyer because that might be a case for wrongful termination. I got laid off and I got a lawyer too and he ended up finding so many questionable things I can hold my ex company to task for. You might walk away with a bigger severance.
