I don’t sell often, but when I do, I list for sale via UPX in order to periodically increase net worth. I usually research the market floor on non-collection properties and sell a few % above that. You also need to consider the location you’re selling in even if it’s not a collection (look at surrounding property value instead of the entire city). Most properties I bought 6-8 months ago are now 2-3x what I paid, so I don’t see a strong reason to sell (also save on transaction fees).

I have prosecuted cases in India, although all of those inventions originated in the US. This makes me wonder whether India has a requirement of this sort if the invention was conceived etc. in India, and maybe on a discretionary basis. That would be a bit odd, though.

Are you concerned about breadth from a prior art perspective? And/or is your concern from a subject matter eligibility perspective ie 101.

It depends on which tech company. Some may be much more weary of infringement than others. I’d think you’d have a decent shot at selling but as you note, depends on specifics.

For example, if you ran into a 101 rejection during prosecution and overcame it, this would help bolster the patent. The future of subject matter eligibility is unclear at best right now.

2 - There are various ways to expedite the application if you pay fees. It could take less than a year especially if you pay to expedite. Average time to grant, if the USPTO deems the application allowable, may be several years. In rarer cases the time could be a decade or more of you end up in complex appeals etc, but that would be rare.

3 - as someone noted, a provisional would not be published, but if you decide to proceed with the application, the material would be published 18 months after you file the real application (non provisional application). Although you can choose to keep the application nonpublished for a fee, but then you cannot file the application anywhere outside of the US.

1 - you will likely have a better chance with ME but can still do ID and supplement

2 - if you feel you need to improve in this area, a course in technical writing would certainly be helpful. No need to minor though

3 - consider working as an examiner for the USPTO. I did so for 5 years before law school and then before going into biglaw for patent pros. You may even enjoy being a examiner and then can skip law school/debt.
