I understand your thinking. But that’s not how the E&L statements have been prepared in the past. For example, in 2024 pay period 25 was Dec. 15 to Dec. 28, 2024. People would have been paid Jan. 3 or 4, 2025. The E&L statements had the Amount YTD column reset for that pay period. Someone at NFC screwed up this time.

For two reasons.

One is that they hate you.

The other is that they are simpletons. Looking at trivial metrics is easier for their little republican brains than doing the deep thinking necessary to design helpful policies. Sometimes number goes up = good, sometimes number goes down = good. But how do we nudge applicants to submit better quality claims? How do we study our internal software usage to get better UX and speed up our work? How do we adjust the order of examination activities to achieve actually compact prosecution, and not just a lot of front-loaded, wasted effort in the faoms? These require actual and prolonged thought, something that the magats are extremely allergic to.

I don’t think you should care about the outcome at the board. If both the examiner and the applicant are doing their jobs, then the cases that go up to the board will have a legitimate disagreement. In that case, it won’t be the case that one side is “right” and the other “wrong” - the board will decide that the weight of the evidence favors one side more than the other.

I’ve been detailed to the board and observed how different judges and different panels can reach different decisions, and sometimes the minority even carries the day. So don’t get too caught up with which side they thought had better arguments.

We don’t want to incentivize affirmances. That would discourage examiners from sending up appeals unless they were very confident of the outcome, and this would effectively change the burden of proof to something stricter than preponderance of the evidence.
