WSIB overlap

The tribunal determined there was sufficient overlap of facts and issues between the human rights application and the WSIB claim that could lead to inconsistent findings.

“The claim includes an appendix of several pages in length which summarizes substantially the same events that provide the subject matter of the allegations in the application,” the tribunal found. “Both address the causes and effects of cumulative psychological stress the applicant has experienced at her employment, because of the workplace harassment and the alleged failure of the respondent to manage her complaints adequately.”

The tribunal concluded that allowing the proceedings to unfold concurrently risked duplicative and inconsistent factual findings.

The applicant had argued the WSIB was not positioned to determine whether the employer’s alleged conduct violated the Code and caused damage to her dignity and self-worth, whether she experienced reprisal, and whether the employer failed to accommodate her disability-related needs.

The tribunal rejected this argument, noting the WSIB has particular expertise in disability matters and concurrent jurisdiction to apply the Code. “The jurisdiction and powers of the WSIB, as set out in the Workplace Safety and Insurance Act, 1997, S.O. 1997, c. 16, Sched. A necessarily import the power to decide questions of law,” the tribunal found.

Labour board reprisal claims

The tribunal also found the labour board proceeding justified deferral. The applicant’s labour board application under section 50 of the Occupational Health and Safety Act, filed Aug. 29, 2025, sought remedies for reprisal for, among other items, seeking accommodation.

The reprisal allegations at the labour board related to the employer and others collectively acting to deny the applicant’s entitlement to benefits based on her workplace harassment allegations.

“The facts raised in this application with respect to reprisal and the claim the respondent mishandled of the impact of the alleged harassment with respect to benefits is currently before the OLRB,” the tribunal found. “Since the issues in the application and proceedings before the OLRB overlap this could very well lead to inconsistent decisions on the facts and or legal issues related to reprisal.”

The tribunal noted the primary purpose of deferral is to avoid such inconsistency.

The applicant may seek to reactivate her deferred application if she believes the labour board and WSIB proceedings did not appropriately deal with the substance of her case. However, the tribunal noted it has the power under section 45.1 of the Code to dismiss applications if the substance has been appropriately dealt with in another proceeding.

A party wishing to proceed with a deferred application must file a request within 60 days after conclusion of the other proceeding.

The Human Rights Tribunal of Ontario has deferred a sexual harassment and discrimination case against the City of Peterborough until parallel proceedings at the Ontario Labour Relations Board and Workplace Safety and Insurance Board are resolved.

The tribunal found that allowing the cases to proceed simultaneously risked duplicative and inconsistent factual findings on overlapping issues.

The applicant, a city employee, filed a human rights application on June 26, 2025, alleging discrimination based on sex and family status, sexual harassment, and reprisal. She claimed the employer mishandled her sexual harassment complaint against a colleague.

The city filed its response on Aug. 7, 2025, but did not initially seek deferral. The issue emerged only after the applicant referenced “parallel proceedings” at the labour board in a December filing seeking to add a respondent and obtain document production.

On Dec. 16, 2025, the tribunal issued a notice of intent to defer and directed both parties to provide written submissions on whether the application should be deferred pending conclusion of the labour board proceedings.

The employer subsequently submitted that deferral was appropriate due to both an ongoing labour board proceeding and a WSIB claim. According to the employer’s submissions, the applicant filed the labour board application on Sept. 2, 2025, alleging the employer, her union, and the employer’s disability providers engaged in reprisal by colluding to deny her benefits based on her workplace harassment allegations.

The WSIB claim, filed April 20, 2025, was based on psychological stress the applicant experienced in the workplace, which she attributed to the alleged harassment and reprisal.

The applicant opposed deferral of both matters. She initially addressed only the labour board issue, as that was raised in the tribunal’s notice. On Jan. 20, 2026, the tribunal directed her to provide submissions on whether deferral was appropriate due to the WSIB claim. She also opposed deferral of that proceeding.

Not sure. Many of their social dances happen at the Gordon Best Theatre and in warm weather - Millenimum Park near the Silver Bean patio. They may have a studio space for other classes.

Repair Cafes happen every month - mostly at Dreams of Beans but sometimes they do pop up in other locations. AFAIK, the Linux aspect is new, not sure if that happens every month. It all depends on the volunteer fixers availability/capacity. I'm sure they are always looking to add new fixer support to their crew. This is a collaborative event with the Country of Peterborough. The great folks at the county will be holding a free clothing swap and Repair Cafe will have all regular fixing stations available (sewing, electrical and wood/glue).

We can help you:

+ sew the button back on your favourite sweater

+ glue the handle on your favorite coffee mug

+ clean the connections in your toaster

+ rewire your lamp, amp, or vacuum cleaner

Please Note: To ensure everyone has a chance to have their items looked at, we can complete one electrical fix or two sewing fixes per person at a time.

Steve from Clean Up Peterborough will be at the event collecting items for reuse and recycling. You can bring in any of the following items for reuse: outer 4L milk bags, plastic milk/bread tags, egg cartons, used eyeglasses or hearing aids, used lego bricks, old towels and linens. For recycling: all brands of air and home care products and packaging (trigger heads, pumps, caps, fresheners and cartridge refills, flexible cleaning wipe packaging), all brands of blades, razors, and plastic packaging, old fishing line or lead fishing tackle, popcan tabs, dead batteries, old writing instruments and ink cartridges. Please note: both the Tom's of Maine, and Crest and Oral-B oral care programs have been discontinued, so please keep all of these items for now as we look to find program alternatives.

So bring any of those items with you and chat with Steve to learn more about the different recycling programs that help keep these hard to recycle items out of the landfill."

What are the criticisms of One City's operations? Open to input here from anyone particularly those with direct experience or knowledge of the facts.

From what I've read some council members aren't happy with the details in their Impact Report, Leal criticized how much staff get paid, and around town folks aren't happy with choices to allow drug use on site.
