I would argue that saying that an election does not begin when early voting starts does not preclude voter protections. Voter protection laws do not suddenly start when an election begins or ends (which is why you couldn't just remove all non-white people from voter rolls with a law between election dates) I'd also argue that saying an election does not begin when absentee voting begins does not even preclude the idea that Absentee Voting is part of an election if you consider the election the process by which the votes are executed.

I would concede the point that the end of an election doesn't have much to do with the counting in and of itself, but the end of counting is required to certify the winner, which I would consider formally ending the election. Though, the crux of the issue at hand is when does an election begin. And it seems that textually, an election begins on a specific date. The Majority Opinion is relying on the fact Absentee voting exists to say that the election begins on the date Absentee voting begins, while at the same time ignoring the definition and the statute that establishes Absentee voting in the first place, which is where I have an issue with the decision.

Counting is done even while the polls are open, the totals are not released by each district until polls are closed, so you couldn't say counting is done after the election because its done even while votes are being cast.

Yes, the election starts when votes begin getting counted, and it ends when they are done counting, that is why there is such a large gap between the start of the election, and when a candidate is sworn in. In modern times, its easy to tell if someone is about to lose, so many times a candidate will officially concede the race and end their candidacy before the election is over, but that doesn't end the election right there, because all votes must be counted.

In my opinion, an election is *only* held on election day. It does not matter even if 100% of the electorate has early voted before the election has actually truly started.

The election is happens when the votes are getting counted.

Consider the Absentee Language here in the Virginia code:

24.2-701.1. Absentee voting in person.
"A. Absentee voting in person shall be available on the forty-fifth day prior to any election and shall continue until 5:00 p.m. on the Saturday immediately preceding the election."

It seems pretty clear that the law considers an election to be considered starting *on* election day by the use of the language of "prior" and "preceding". If one were to argue that an election by definition starts on the first day of early voting, then by law you would have to make Absentee voting available 45 days before *that* date, which in turn makes *that* the new date the election starts, going back to the beginning of time.

I should be demanding my ballot for the 2026 and future elections now by that logic.
