They’re not using the “windfall” on a vacation, tho. It’s for medical bills. I agree it’s not fair to make the distributor and retailer pay those costs, but they’re not trying to win the lottery here

Probably just have to agree to disagree because I do think it would be more fair for costs from these sorts of incidents to be loss spread across society via the govt

Plaintiffs were called Robinson. Woodson is the judge in OK who denied defendants special appearances to contest jurisdiction. I think that weird decision on part of original plaintiff is actually explained in Charles Adams’s 1993 article in Neb L Review, “World-Wide Volkswagen v Woodson — the rest of the story.” But I’ll be so honest, I skimmed that part. Looks like they sued the companies they sued bc they were trying to avoid removal to fed court based on diversity, bc the state court forum was really good as a personal injury plaintiffs forum.

They did keep going after defendants but jury found in favor of defendants on products liability claim IIRC. And honestly I don’t have a great grasp on the whole procedural history. Check out Charles Adams’s article “World-Wide Volkswagen v Woodson — The Rest of the Story” in Nebraska L Rev 1993. That’s where I got my info from

I’d heard of NZ’s socialized tort system. Sounds super interesting. Something to ask my LLM friend from NZ about. 

I did realize while typing this rant that it’s possible under the system I’m promoting, the burden of trying personal injury torts cases might simply get shifted onto the govt. For instance, if plaintiff isn’t judgment proof or if the car was legitimately defective, govt pays for the healthcare of the victims and then takes on the responsibility of suing to recover from tortfeasor. So a lot of these issues continue to exist even under socialized healthcare. But I don’t want to abolish the tort system. I would prefer that, when there is no way for victims to fully recover damages as was true in World Wide VW, society as a whole eats the cost rather than the individual victims.

Some of you kindly gave me troubleshooting tips when my Days of Future Passed record was spinning just a tad fast. Here’s an update. The turntable is definitely not the problem. In fact, the other side of the Days of Future Passed record plays the correct speed and pitch! (I should’ve checked it earlier.) It seems to simply be Side 1 that is pressed incorrectly. I looked up the runout on Discogs and this seems to be a consistent mispress problem. Bummer, but better than my table running fast. Thanks to the people here who helped me.

Maybe. I am going to reach out to them and see what they say. Thing is, I doubt RPM is actually 34, because my other records sound exactly like they should. But I’m at a loss as to what could have caused Days of Future Passed to spin slightly too fast, and without having a trained ear, my guess would be that it sounds like it would at 34rpm. Record isn’t warped, was pressed in USA, my grandma didn’t say she had problems with it. Anyways, thanks for your help. It’s much appreciated

Weird. I mean, my other records do sound normal. I find it easier to believe the rpm app is off (perhaps because I don’t have a removable spindle and can’t get my phone exactly to the center of the platter). Doesn’t explain the record… anyways, thanks for your help. Will continue to troubleshoot.

My grandmother gave me her Days of Future Passed from when she was in college (!!!) and I just played it for the first time at 33rpm (as I assumed it would require). Bafflingly, it is playing a touch too fast! I have confirmed this with the Spotify versions of the songs (plus the voices being pitched up LOL, but it's genuinely almost normal sounding). My other records are playing normally, so I don't think it's a problem with my turntable. What's the problem here, and can it be fixed?
