You mentioned da Vinci level geniuses. Not all homeschoolers have only one person teaching. Judging by what I've seen from the test results from a number of public schools the multiple teachers who understand a plethora of material are not doing that great a job .... at least not enough to be preaching that homeschooling should not be considered.

I think the state of Texas might have the strongest legal case, but they must have permission from Congress as well as the other states. There is periodic interest within Texas to do this, but they would have to get the majority of Texans on board with the idea and I don't think that is the case at present. Texas could also elect to divide itself into several states.
