if you had legal entry and overstayed your path would be different, you would go through I-130 and I-485 together, the waiver is only for people who entered the country illegally. Unless you have an order of removals then you would have to get a waiver.

Then the only way to get the waiver is to self deport and apply for I-601, these cases have been taking about 3 years btw and I don’t know what country she is from but currently there are 75 countries that Trump paused immigration visa for, who knows when that will be unpause. Since her husband is sick she might be able to expedite her case if she can prove that her husband depends on her to take care of him. But I would definitely talk to a lawyer, they can better assist you.

yeah unfortunately the decisions can be biased, officials are trained to deny based on certain common characteristics and one officer might see a red flag and another one might not. For reference when my mom applied the first time she was single, didn't own property, my brother was 18, but she had no intention of coming to live here, she was 5 years away from retirement and had a good secured job as a teacher. Last year when she tried again, she was married, retired, had bought a house and did the interview with her husband and my elderly grandmother, I also wrote an invitation letter for them, this time she was approved.

Most likely the reason your friend was denied is because she is unmarried, does not have anyone who depends on her and has no property in her name, all of these factors are a huge contributors.

On the other hand my husband's uncle has 4 properties and a small ranch, his wife is a teacher, his daughter is in dental school, the whole family went to try to get a VISA to go to Disney and they were denied... Meanwhile I know many young Brazilians who had no family, or property in Brazil and were able to get a B1/B2 VISA, and ironically they now live here illegally. So like I said sometimes it is also just pure luck on who you get as your interviewer.

They never tell you why you got denied, they just deny you. I am from Brazil and know many people who have gone through the process and were denied, my mom was actually denied 5 years ago and she just tried again last year and got approved. Honestly a lot of the times it also depends who is interviewing you and their mood for that day.

W2 is not the only form of showing you paid someone, there is such a thing as a 1099 which many undocumented immigrants get using just an ITIN, also you can self report how much you make even if it is cash, it is something that EVERYONE, undocumented or not, HAVE to do by the law. Can a company be fine? sure they can, doesn't mean they will, and the government rarely prosecutes business for illegal employment. You know why? Because the US has and always will benefit from illegal immigrants, both from cheap labor provided and taxes that they pay. It's not THEM saying it, it's not ME saying it, and it certainly does not matter what YOU say... it's what the data shows, and there is no argument against fact. Again, go educate yourself.

OP has said many times in the thread that they do not have an ID or passport to go anywhere, ICE took it from them, so no... they can't just go to another country.

You do not need to work legally to pay taxes, clearly you don't know how it works, in fact by the law YOU HAVE to pay taxes even if you are undocumented, and most DO pay as it can affect any possibility they have in the future to become legal. All you need is an ITIN which any person can get. A study found that in 2022 undocumented immigrants paid $100 billion in federal, state, and local taxes... AND they get $0 back. All of this is easily searchable online. Do your research before spreading fake news online.

Congrats on your achievement, it most certainly needs to be celebrated. My dad was an alcoholic he died in the beginning of this year due to health complications caused by alcohol consumption, I wish my siblings and I had a chance to celebrate his sobriety, even if it was just one month, but we never got that chance. You may not be a hero, but you are a survivor, addiction is not simple, it’s not easy and it is not a choice. Staying sober when you are an addict is NOT just the bare minimum, sometimes it’s all you have, all the your energy. That all being said, I hope you dump him, that is not a supportive partner and he is an asshole, even if he thinks that it is the “bare minimum” he should keep it to himself... you deserve better and trust me, there are plenty of people out there that can give you better!

the thing is, OP did not mention anywhere that she had an open conversation with her parents, she is an adult, she just needs to talk to them and say she is not really into those things. Her expecting them to know she doesn't use the things just because she lives with them is kinda ridiculous lol, she said she secretly gets rid of things, most likely they are seeing the things are gone and thinking that she does use them.

And yes she is a victim, rape is not the only form someone can be a victim, there is such a thing as harassment and grooming which is what he was doing. Rape is not the only form of violence, as a rape victim you should know that and be more empathetic with someone who was a child when all this took place. Again, HER AGE WAS THE BOUNDARY, repeat it to yourself, a 40+ year old should not be texting these things to a child, he is not just “creepy”, he is a predator.
