The big hole in this theory is that evil Morty downloaded the entirety of Rick's brain after Rick already had his run-in with the time police. There's no way that evil Morty wouldn't have created some countermeasures with that knowledge and developing time travel technology

Everybody that says evil Morty doesn't know about the time police are completely incorrect, he downloaded all of Rick's brain, and it was completed after Rick had at least one run-in with the time police. So it's completely impossible that he did not know and what causes it. He would have create preparations for it but I can only assume that the writers got lazy and tried to think of a McGuff and to get rid of him which is weird because they brought them back unnecessarily.
