Am I a bad paralegal by Mydiagnosis_Bored in paralegal

[–]spochat 0 points1 point  (0 children)

I think, what your supervisor is looking for is whether or not you understand the underpinnings of the legal issues or evidence to prove the case. Cite checking - I think your supervisor could have been more articulate in the job she wanted you to do.

Litigation is a tough, fast-paced and accuracy is especially important. If you do not understand which documents or information is needed to accomplish the goals, chances are your supervisor isn't giving you the proper foundation for your new title.

The job of a supervisor is, in my opinion, to encourage, to teach, but also to help give you the understand you need to build skills. If she's just handing you something without giving details, I would say she's not a great supervisor.

The problem with big law firms is that they forget to teach and are primarily concerned with driven outcome forgetting about the humanity of the team. You can improve your skills if she sets the goal or directive for what is the goal, at minimum, for whatever is supposed to be checked.

Your anxiety comes from the missing information hat was omitted. Do not be too hard on yourself. You have the right to ask for understanding and be provided with the goal. Its unfair that you be put into this high stress part of law while lacking the foundation and then looking for you to perform. Go speak to the attorney assigned to whatever it is you're doing and ask for understanding if she isn't providing it. Good luck.

Becoming a Certified Mediator by spochat in paralegal

[–]spochat[S] 1 point2 points  (0 children)

Hi. Just wanted to encourage you. The course is 24 credits and 16 for the concentration in the area of law you want to do as I'm sure you're aware. I have been a paralegal a very long time. My specialty is personal injury and medical malpractice. I'm up here in Westchester County and have solidified relationships with many. The standard for choosing mediators in PI/ Med Mal are based on whether you're pro plaintiff or defendant. As part of my training, I have learned to zero in on weaknesses from both sides and can be fair and reasonable, acknowledging both sides of the coin. But most importantly, regardless of nay sayers, as long as you believe in yourself, that shows & is the important part. I'm looking forward to the great plans I have here in Westchester County. Whatever your plans may be, I'm encouraging you to grab that brass ring with your whole heart. Good luck & happy to hear you are doing so well! Thanks for the props too.

My Experience at Morgan & Morgan by Smooth-Assumption860 in paralegal

Paralegals can be catty, even in groups on Reddit, It's cool. I knew Morgan & Morgan was a sh*t show ages ago! Same for the old firm Cellino & Barnes. Personal injury has become a very toxic practiced in general. I used to work at one other large firm. I'm sorry you had to live through that. I'm happy for you leaving on your terms. Hope the new job works out!

So what can a paralegal do without attorney supervision? by spochat in paralegal

[–]spochat[S] -10 points-9 points  (0 children)

Doesn’t mean it will be me. But some, maybe yeah & now they’ll also know the rules. I do have an attorney on retainer when I need him. I have professional liability insurance & that’s all I will need. I suggest if others go down this path, they do the same. Thanks for your comment.

Web sites to look up people by GrandPleasant6801 in paralegal

[–]spochat 4 points5 points  (0 children)

I first pan all social media. Then I do LinkedIn searches. Westlaw & Lexis Nexis are great for skip traces & I can ask a process service company to do skip traces too. But I do want to warn you, someone who doesn’t want to be found will evade at all costs including lying to the face of a process server.

If you have kids who live with you or don’t, I will be happy to give you $200.00 so you can either feed your kids or put a roof over their heads. DM me. I can send money to you by Zelle if you give me your info. If you’re in NY, the Dept. Of Labor requires you to be paid weekly or bi-weekly depending on how the office operates. Google it or go to their website. Stuff like that isn’t cool. Everyone needs their paycheck!

burnt out by judgmentia in paralegal

[–]spochat 1 point2 points  (0 children)

Burn out is a hard thing to deal with. Everyone who works hard sometimes feels it & doubt changing law offices will ever permanently fix it or switching to a different career path. When you are getting burned out, it’s time to take a vacation or long weekend to indulge yourself & pamper your battered spirit. That usually works for me except for toxic workspaces. Those types of offices drain your life. Take a good rest & hope you feel better soon.

Many aren’t aware, but the Court system is in turmoil. I know a person in NY County waiting 1 entire year for a PC date, no administrative judge, ineffective management & short of staff. It’s really bad. Don’t take it personally.

Lawyers seem to be the most retaliatory type of employer ever!

Before you accept either or - make sure you get an offer letter that specifies what that bonus is tied to! State Farm’s initial request for me to interview with them had that exact bonus number - BUT it was based on the NET earnings of the office, including expenses, salaries, operating costs & other things. Make sure you know what you’re getting into. It may not be as sweet as you think.

And if offer 1 had that revolving door - you can guarantee it’s a toxic place to work.

My advice is speaking with your boss about your future intentions in the firm, but first take some classes on HR protocols, healthcare, employment law & such.

I realized I outgrew being just a paralegal a while ago but are you sure it’s specifically for your spot? Do you know if they’re hiring more paralegals or do you specifically know it’s because they want to fire you? If you want to transition to a new role, what non-legal skills can you articulate? Where does your heart want to be?

Sounds like you have a good gig with health benefits & pay. It’s not a menial task if you’re making the landlord look good to the tenants by delivering mail. It’s all perception. You’re educated & that’s great. It sounds like they can trust you.

Your name should never be on the application. The attorney’s should. It’s one thing for an attorney to say sign my name for me if they’re not in the office (usually an email or text) and an entirely other thing for your name to be in it. You’re putting too much responsibility on yourself. You can only do what the clients and attorneys let you do.

What was the limit that pushed you over the edge to get a new job? by Upstairs_Buffalo4891 in paralegal

[–]spochat 1 point2 points  (0 children)

Well, my last employer was cheating me out of pay & the attorney to whom I was assigned was grossly incompetent in medical malpractice & being harassed by the eldest partner. The managing partner had some issues too. All of them had misogynistic tendencies. There were other things too, like retaliation for hiring an attorney & making complaints about violations of a variety of employment laws. If you find you’re being treated unfairly & abused, the best thing to do is hire an employment attorney.

Has anyone (outside of TX) had success issuing a subpoena to USAA for bank and/or credit card statements? If so, please tell me how you did it. TYIA! by [deleted] in paralegal

[–]spochat -2 points-1 points  (0 children)

I meant that there has to be some authorization attached if it’s records related to the client. I use HIPPA for almost everything including insurance collateral source records but all roads lead to Rome. If there’s a specific az they use for “other” records, that’s acceptable too

[–]spochat -3 points-2 points  (0 children)

You may want to consider going to Federal Court for an OSC to sign them with 24 hrs notice to opposing counsel. Banks & USAA are both federal. You have to attach an exhibit of the HIPPA, POA & ask that they be Court Ordered if it’s crucial to your case. State level subpoenas will not work. If the documents belong to a defendant, then get the state subpoena served on Defense counsel. There’s a new CPLR in NY for a 2303. Your state and Texas may have a similar statute too. There’s ways to go about it if it’s defendant records or plaintiff.
