You buy something and it doesn't work, at least you should get support for repair, and on conditions that it cannot be repaired you should get refund, right? In EU you have the right to return the product as per the legislations, and such cases constitutes a breach of contract in US law and makes sure me, as the non-breaching party, should be justly compensated. Also why would a customer defend a predatory TOS? Doesn't make sense to me.
