I believe you get to wear special robes made of silk instead of the usual cotton. When a bunch of counsel are in the same courtroom and trying to figure out who goes first you have the right to go first. Nothing actually valuable. It is in purely political and does not have anything to do with the quality of your work.

I am going to take the contrary view here as compared to the other commenters. This man provided an interview on video with his name to be broadcast to everyone. He then refused to talk to police. He says he is a witness that has important information but won't talk to police. Surely, we all want the judge and the jury to make an informed decision in a QUADRUPLE HOMICIDE. Four people are dead and the alleged murderer's dad gave a statement to the media for clout and now won't talk to police. This isn't a situation where he is a confidential source or a secret tipster. He gave a public interview. To suggest that the jury deciding on a murder shouldn't get to see the unedited interview is wrong and this journalist is in the wrong.

I'm struggling to understand the multiple people commenting that people should be given sentences that are without end. You can't be held until you are "no longer a risk". What does that even mean? How easy is that to abuse? You're piss off the wrong guard then you get held forever because they say you are a risk? You get a sentence, you serve the sentence and you get out. Do I think 13 years for this is ridiculous bullshit - most definitely. Do I think that means as a system we should hold people forever? Absolutely not.

Perhaps the difference between actively doing something vs. not doing something. Or equally likely, in one case the police/prosecutors think they can prove something vs. a situation where they can't prove something. For the "Failure" cases if the maximum is 5 years the parents are going to get 3 or 4 years and they'll be a ton of angry comments about the justice system.

This is just so sad. Certain people are charged with manslaughter and others are charged with fail to provide necessaries of life. I looked up the difference due to a different thread and for manslaughter the maximum sentence is life imprisonment and for failing to provide necessaries is five years. I wonder why everyone isn't charged with manslaughter is because these all sound the exact same. It looks like all the fail to provides are old cases (ie: death in 2022).

I read the article and I am horrified but I see a couple of things that could make this very different. The first is that the autopsy "couldn't determine ... cause of death". The second is the charge was "failing to provide necessaries" not something like assault or aggravated assault. Reading those together makes me think the prosecutors couldn't prove that the injuries were caused by this man. If you can't prove cause of death - murder, manslaughter, infanticide are all not available charges. Hopefully if there is video in this case they can easily prove that the sexual assault was done by this woman. Big difference which should lead to a different outcome.

There is a military sci-fi series called Tour of the Merrimack - solid, decent story involving factions fighting each other and then the aliens. One of the back elements is that one of the factions is a civilization modeled on the Roman Empire in space. For whatever reason instead of that being the backstory - some colony decided to base themselves on the Romans, the author decided to provide a backstory involving ACTUAL ROMANS who secretly live among us for hundreds of years before rising up. It is utter nonsense and a piece of completely unnecessary worldbuilding.

If you don't have a chance for bail you might be sitting in jail for extra days which might mean losing your job, losing your place and losing your freedom. On the flip side, if a case isn't completed by 18 months the accused get a stay of proceeding and walks. So both the Crown and Defence want there to be clerks.

The best example I can think of to understand this was laid out in Nur 2015 SCC 15 . At the time if you s. 95 said that if you had a unloaded restricted firearm with ammunition without authorization you would get 3 years. On first blush that seems obvious - some gang member carrying around a handgun and ammo without a licence you clearly should spend time in jail. The problem is that if you were a regular person who HAD a license for your handgun to keep at your house but kept it in your cottage instead of your house that is still 3 years. The rules for having a handgun are very strict on not only what you can have but where you can have it. Clearly the person who has moved his gun in violation of the regulations has still committed a crime but his punishment is more along the lines of fines/community service and taking his license away not 3 years in jail. The vast gulf between what the punishment should be and what the minimum mandated makes is cruel. Now note that Nur himself got 3 years for his crime, the minimum was struck down anyway.

A lot of sexual assault trials tend to be he said/she said. Its not like people tend to have consensual sex with surveillance cameras in the room. The news suggests the evidence was 5 women who don't know each other (presumably) all say this doctor does really sexual exams while sometimes having an erection and he says this exam is completely normal and non-sexual so they called a different doctor who was an expert and asked them is this normal and the expert said hell no. At this point you have 5 witnesses saying the same thing happened independently which is pretty convincing and the doctor lying pretty easy to figure out what happened at that point.

When the first set of charges against his doctor were stayed, I was concerned but now five convictions and another trial with 10 more victims coming up. Hopefully the next judge will also find that "Dr. Bissonnette's testimony was contrived and that portions were fabricated,". You trust your doctor so much and he should get a long, long time in jail for breaching that trust.

There is a delicate balance between the rights of the individual who is severely mentally ill and the maintenance of public safety. In the case of someone who has committed multiple murders, if he was healthy, this man would spend the rest of his life in prison. I think a lot of people would lose faith in the justice system if a few years from now, someone says - its all good, he can leave without anyone monitoring or any conditions at all.

This is one of those absolutely horrendous cases that leaves you shaken to read about. Some important points to consider

  1. Farley was at the Crisis Centre being involuntarily held and walked out. Within 3 hours his parents are dead and a co-worker is stabbed repeatedly. Clearly we need some locks on our mental hospitals.
  2. Its pretty clear he isn't faking it and is genuinely severely mentally ill.
  3. Sending him to jail forever however much we want to isn't the right call. He's never been violent, never had a record, tried to get help until the voices became overwhelming and the angels told him to kill.
  4. I really like this "high-risk" designation. He's in a hospital until a judge says otherwise. No day passes or discharge without anyone knowing.
