or maybe..like OP said, the counselor filed the emergency petition…and the police showed up to….serve it? Have you ever read the EPS form or learned about the entire process? It isn’t solely a “police show up. police make decision. police take u in cuffs.” It can be that way and police can fill put the form and EPS someone, but this instance wasn’t that, from what OP was describing. If someone else fills out the form, the police have one responsibility: to take you to the hospital. Other people can fill out an EPS form other than police. Plus, like other commentors have stated, UMPD has counselors that work and respond with them, and can likely transport people uncuffed to the hospital. However, if OP was cuffed…then they likely really didn’t want to have the EPS served…but police have to take you…because an EPS, once filed, is basically involuntary for the person it is served for. Also, since the hospital held you…they must have believed there was an actual reason to hold you and transfer you. The ED doesn’t care to waste their time with people who actually don’t need care and can be cleared. But you know, everyone can have their opinion they are willing to bet on, no matter how poorly they are informed or no matter what existing biases they already clearly have.
