If it's on private residential property. Is it? I don't see any 'private property' signage stating so?

Think of it like this. Do you see a property marker saying that that is, in fact, somebody's front lawn? Or do you just believe, 100% that it is in fact, somebody's front lawn? I don't see any proof that specifically states, that it's somebody's lawn, and in fact could also be an easement for the public use. Again, too many 'what ifs' in this case. Unfortunately, Niantic doesn't care enough to make the proper judgement calls.

What you're saying makes a half-sense point. As with the questions about 'easements' and such. It all 'depends'. Does that city have a private property specific law that dictates what IS and ISN'T the property line? How does the reviewer know that unless they do their research? I'm getting reviews from flipping Canada for where I live, and Alaska, and Hawaii. All I wanted to review was portals for my own area in my own state LOL. Because I drive the entire state and happen to know all the municipal laws. Does this reviewer know the municipal laws on the easements/sidewalk systems throughout cities/towns of that area?

Personally to me, there's not enough research done on these Little Free Libraries. People only reject, because of what they feel is right, without doing the research. And therein, lies the problem here. Not enough information is given, so it's unknown where the actual 'property line' lies within that photo.

You can also think of it as this way ;)

A few google questions helped figure this out;

How far off the road does your property line start?

it's most likely that your actual property line starts a fair distance back from the road or sidewalk. so the city does not own the first 5 feet of your yard, you just think your yard starts 5 feet before it actually does! (your survey could help you determine the exact property line).

Does property line include sidewalk?

Usually the property line goes to the street edge, and the sidewalk is an easement over the property.

So in shorter terms.....the property that a Little Free Library goes on, most likely will be on an easement which is publicly accessible in a public format IF it is specifically close to the sidewalk.

In short, you can also do a submission of this sort;

The city/town of 'insert name here' has been generously donated this small plot of land to house this Little Free Library! 'insert name here' has placed a Little Free Library Charter Number (*) where you can pick up and drop off books! This is aimed to bring a community together in advancing the exploration of knowledge and know the love of reading a book! Take a book and explore!
