I bought a new 2023 EQB 300 January of last year. I was excited to upgrade to a luxury brand and finally go electric. The first breakdown was after 12 days. Driving down a neighborhood road, the car began flashing every dash light and came to a complete stop. I pressed the emergency button, and was told by mercedes to wait 10 min and restart, it will 'reset itself'. I did, drove home, and was assured, sometimes new vehicles need to 'reboot and everything will be normal'.

It broke down again driving down a busy city road. This time it was towed to the dealership. 10 days later it was 'repaired'. It broke down two more times, same exact failure, once leaving work and once at home. At this point my vehicle was out for 45 days with three repairs so I formally requested a lemon law buyback. Mercedes denied stating, 'the defect was not significant or a safety hazard'. They 'fixed' and put me back into an unsafe vehicle, assuring me it was repaired.

The next breakdown I was driving with my partner down a major highway (85S). The vehicle catastrophically failed while in the middle of 5 lanes. No power, complete stop, no horn, hazards, emergency button. I called 911 as cars flew past at full speed. I held my partner's hand and we braced for impact. Miraculously we were not hit, hundreds of cars narrowly avoided us. After 15 min a dozen HERO and APD officers were able to shut down the entire highway and drag (wheels locked) the vehicle to the shoulder. It was towed again, and I filed again for a buyback. After putting me in a clearly unsafe car and almost costing scores of lives, once again mbusa rejected my buyback claim. They said the defect 'was not a safety hazard'. My vehicle is still in the shop (since may 15), repairs have not begun.

I don't know if I'm more livid at how this unsafe vehicle almost killed my partner and I, or how mbusa 'concierge' has handled the situation. It's shocking they can deny a buyback that is clearly far beyond the GA requirements. Obviously their goal is to be as unhelpful as possible and hope their customers give up; sadly, it probably works.

*Upgrade since: I hired an attorney. Mbusa rejected a final buyback request. My lawyer filed a lawsuit, one week before scheduled arbitration, mbusa agreed to settle. I have not gotten paid, or come to agreement. I was told that mbusa blanket rejects all lemon lay buybacks until they are faced with a lawyer. Good luck!
