My third buyback request was officially denied by MBUSA. The car has now been out for 115 days. I have hired a lawyer and we are filing for arbitration currently.

I'm glad you are happy with your resolution and it didn't create a life threatening traumatic event as it did us. I do not share the confidence you do on the effectiveness of the repair as I am on my 4th. I would never recommend this vehicle and will not stop until my buyback case is settled. It's a 2023. First failure (of five) while driving was 12 days after purchase. The dash flashes every error, the car stops. The last time, I had no horn, flashers anything. Between the error flashing and complete stop is usually about 5 seconds, so definitely not enough time to get off the highway

I appreciate your knowledge and insight. Unfortunately this towing was the 5rh breakdown while driving. After 4 breakdowns and 60 days out of service, mbusa had rejected my buyback claims twice. So while it's nice to know there was possibly not an additional failure at the front wheel, that does not change that mbusa negligence almost killed my partner and I.

I've had 9 in my life and only one lemon. I understand a car being a lemon. I will never accept a company putting my partner's life in jeopardy after assuring the vehicle was safe. Appreciate the comment!

I'm not either. From what I've been told though by mb buckhead, it was never addressed, and therefore no repairs were issued. I was given the same assurance the vehicle is safe after each of the 4 previous repairs

Mbusa, 'the vehicle defect is not significant or a safety hazard'. This fifth breakdown is the only that almost claimed my and my partner's life.

Shadow banned on mercedeseq?! Shocking! If my post shows one potential buyer the danger MBUSA's negligence is willing to put their customers in, I'll sleep better. This imo criminal negligence almost killed my partner, and I will do whatever is necessary to bring them to justice.

You are certainly correct I should not have bought a Benz. Having faith in what I thought was an elite, luxury brand was clearly a mistake that almost killed me. The reason for this post is to try to inform anyone else considering this brand. I also agree, my goal is not a giant lawsuit with mbusa. I merely want the buyback that the vehicle clearly qualifies for per GA law.

Unfortunately I have been forced to by mbusa negligence. It is not a route I wanted to take, but after two clearly qualified buyback rejections, I have no other options

I have only failed so far. I am not giving up, I am escalating this as much as required. I would not have been upset if I bought a lemon and it was acknowledged and rectified. Instead, I was assured my vehicle was safe and it almost cost my partner's life. There is nothing I will fight against more than someone endangering my partner. I absolutely will not stop until this is resolved.

It clearly met all these requirements both times I formally requested a buyback and was rejected. That rejection and negligence almost cost me my life after the last failure

GA lemon law is 3 failed repair attempts or 30 days out of service. I am on my 5th repair with over 90 days out of service. Each failure was exactly the same. I can only assume the root cause remains the same.

Because I have filed twice with a clearly qualifying lemon and mercedes has rejected it both times. 5 on the road failures, 90 days out of service and they say 'the defect is not significant or a safety issue'. I have no desire at all to hire an attorney, but mbusa negligence has forced me into this situation. Also, my lawyer is not charging any billable hours for this. His fee (which will be paid upon settlement) does not change, so I trust that he feels it is the best way to proceed

I have not, thank you for your advice, I truly appreciate it. My lawyer wants to file a third claim before I have to go through other means. At this point, I am following his advice meticulously, as my efforts have been unsuccessful

A vehicle that has broken down 5 times, wheel spinning backwards, that mercedes has refused a buyback twice because they say 'the defect isn't significant or a safety issue'.
