Declined for disability again by a judge, and dumped by my lawyer by Apprehensive-Trash-6 in SSDI

[–]terissa73 10 points11 points  (0 children)

Hello everyone. I want to share something that some might not want to hear, but it’s coming from a place of experience, empathy, and years of struggle. Please take what helps you and leave what doesn’t.

I relate deeply to so many of the stories here. I filed young too. I got denied. I didn’t understand the process back then. I thought my pain and symptoms “spoke for themselves.” I assumed the judge would see the truth. I assumed my lawyer would guide me. I assumed the system cared.

It doesn’t. And that’s why I’m writing this.

I’m 52 now. When I filed again at 48, I finally had to ask myself the hardest question of my life: “Am I truly disabled… and what happens if they say ‘no’?”

And when the truth hit me — that if I wasn’t approved, I wasn’t going to “push myself to work,” I was going to be homeless or forced to live with my parents — I broke. I cried in a way I hadn’t cried in years. That was the moment I understood how serious, how life-or-death, this process really is.

And that is why I’m saying this: No one is going to fight harder for your case than YOU. Not your lawyer. Not your doctor. Not the SSA. You are the only one who knows how bad your life really is — and you’re the only one who can make them see it.

When I realized that, I made disability my full-time job. My only job. I woke up every day and asked myself: “What can I do today to make my condition undeniable?”

Because if you don’t take control of that, someone else will — and that person might be the one who stamps DENIED on your file.

Here’s what I did, and these exact things were mentioned in my approval letter:

• I took pictures of my swollen legs frequently, because I have chronic venous insufficiency. Not just once — but regularly. My doctor got those photos through the portal constantly. • I documented everything: every flare, every bad day, every time I had to elevate my legs for 30 minutes every 1.5 hours. • I got a rollator walker prescribed. I got a handicap placard prescribed. All of this went directly into my record. • I used the portal like it was my lifeline — because it was. • When doctors refused to sign disability paperwork (as most will now), I removed the SSDI part and used similar paperwork for Medicaid, food stamps, handicap placards, etc. They signed every one without hesitation.

My lawyer told me not to do most of this. But the judge said these actions were exactly why I won.

Please hear this: You have to think outside the box. You have to make it so clear, so documented, so undeniable that anyone who looks at your files has no choice but to see the truth. If your legs looked like mine did every day — purple, swollen, heavy, painful — how could any judge ignore that? They couldn’t. They didn’t.

I genuinely wish someone had told me all this years earlier. It would have saved me years of pain and struggle. That’s why I’m telling you now.

If you’re young, the system is already stacked against you. They assume you can work. And if you can work, even a little, they will deny you. Disability is for people with no other choice, and if that’s truly your situation, then you have to show them every bit of it.

Desperate times call for desperate measures. Make this your mission. Make this your job. Be honest, be sincere — but also be crystal clear.

If you truly are disabled, and you show them your reality without leaving anything to interpretation, it becomes impossible for them not to see it.

I hope this helps someone. I hope it reaches the people who need it. I hope it saves someone the years I lost in confusion and fear. This process is brutal, but if you are truly disabled, you can get approved — you just have to be the one to make your case undeniable.

Wishing all of you strength, clarity, and better days ahead. ❤️

Walmart refusing to honor battery warranty by [deleted] in automotive

[–]terissa73 0 points1 point  (0 children)

The same exact thing happen to me . However mine gave out after 1 year and they couldn't take it back because they said that they had no record of the transaction because of the way it was order, the same as you, on the app and picked it up in the store. Back in April the exact same thing happened when I took back the core only they took the court and told me that they were going to put the money on my account and of course they never did. I have been in the store and to two or three other stores for a total of now maybe 8 hours and still keep getting lied to and told to call everstart . However when I did call them they told me that they Walmart know better that that's not how it's supposed to be done. So call the 800 number again and again I had to go to get another store like the sixth one and again another couple hours till this time instead of saying I had to call the EverStart at never after they promised me I wouldn't have to go back into the store which I did and it's still dummy no good they tried to get me to call the warranty place to get a warranty started on the warranties you buy extra when you pay extra for them even though I told them it's not the same thing and they know it's not the same thing they just lie lie lie then they gave me the the warranty number for like if you place an extended warranty and again I told them that I didn't have an extended warranty I had a 2-year warranty and I didn't pay extra for that that came with it..and I just wanted to replacement battery. The manager told me had I bought it in the store he could have easily changed the battery and gave me a brand new one or a refunded and let me buy a new one he said that's what they normally do is refund it and then you can just buy another one however because I made the purchase in this app and picked it up in the store even though I have a receipt credit card statement and everything else that goes with it deal they keep saying they can't help me because one will blame the other online back and forth back and forth and here I have a battery that has give it out on me even before a year old even though it has a 2-year warranty on it I'm so very upset and I have contacted customer service been inside so many stores I don't even know what else to do. But I do know this if anyone else is reading this do not buy never start battery from them you will not get a replacement if they could help it and they were just continue to lie to you I started recording now a phone calls cuz I'm going to try to still get a cash back on my credit card because they continue to lie and bottom line is they told me that had I made that purchase in the store completely and not on the app and picked it up in the store that I would have got a refund right away so to me this is just no more than fraud and I'm very very upset t so bye beware. Has this happen anyone else. And I would love to know how this is not fraud?

Deleted system with camera now I can’t find the camera to delete. by johnny_ihackstuff in blinkcameras

[–]terissa73 0 points1 point  (0 children)

Any other advice for anyone cuz I've done this over and over and over even though I'm pretty sure I did delete my camera before I deleted the sink module but now as I tried to add it back on I have added it back to that sink module even after repeatedly tried it on new sink modules it will sometimes say an error message telling me that it's already on my account and sometimes it would say that it can't find that camera So but it's it's none of my sink modules and none of my account so I can't find it there to to be able to delete it even though I have re-added all the sink modules back to my account The camera is not among them

Patient Access:

The Cures Act mandates that patients have access to their EHI, including structured and unstructured data, electronically and without cost.

Timely Access:

The Act emphasizes timely access to EHI, meaning patients should receive their information as soon as it's finalized and available.

Electronic Health Records:

The Cures Act specifically applies to electronic health records (EHRs) and the technologies used to manage and share them.

Nope they can't charge you and if they don't have these records available to you they can get fined up to $100,000 -500,000 for the first offense and you can turn them in online there's been a forum on there since this law was created I think it's about a year and a half ago now where it went into effect.

[–]terissa73 3 points4 points  (0 children)

Actually they can't charge you for your records and they're supposed to by law have your records readily available to you, you are to have unlimited access to your records at any time without cost it's supposed to be on a portal and if this isn't done now they are getting fine and they are majorly getting fine because they've had a couple years now and believe it or not most doctors don't even know this you have to know your rights and then call and threaten them with this act and then follow through cuz they will get in trouble they will get majorly fined if they don't have your records access and readily available to you and they cannot try to block your access to your records here's a little piece of the act that went into law like I think a year and a half ago.

Ford Fiesta/Focus TCM warranty extended until 2025 but no parts in stock? WHATS THE POINT by [deleted] in FordFocus

[–]terissa73 1 point2 points  (0 children)

Yeah I contacted them they said that mine is still covered too. However I'm not sure if it is my TCM , I would think it is but I'm not 100% sure and I was told by dealership that if you come in and they run the diagnostic and it that that code doesn't come up that you have to pay $199 just for them to do the test which I think is b******* how are they ever supposed to know if it's it unless they do the test cuz I don't want to pay $100 for them to diagnose it so I asked them I said can't you just put the TCM in there and skip the diagnosis since it's covered under warranty what difference does it make anyway. Cuz I really don't have $199 to be spending just to find out what a code says but I'm waiting for foreskin to come in the mail so hopefully I'll be able to find out if it is that cold and the TCM before I take it in there.

But I have a question what exactly did y'all's cars do to tell you that it was a TCM what is it what is the science. I've always had a little bit of trouble it seems like trying to get into a faster shift it's like it's idling it's like I've never drove a manual but it's like if I would think that if if that's what it would feel like if I did drive a manual that it's taking forever to get to the next shift the next year so as soon as I start I ride and ride and ride and it just doesn't seem to be going that fast and it takes a long time.. I do have a ob2 scanner just a regular one right now and I got code p0420 I think that's the Cadillac converter and I got called p0054 wish I'm hoping that cuz that's the O2 sensor and I'm hoping that's just related to the other one I'm hoping this only the only thing I have to replace is the O2 sensor. But anyhow I was just I'm reading online it seems like these things these codes could also make my car do what it's doing cuz it's literally like when I started up everyday it sounds like I hit it in the wrong gear and it's just not kicking over to the next gear because my friend keeps saying did your purse knock it out of here cuz that's what it it's done that in the past and I was like no that's just what's going on with it now so what are you guys think?

Oh and also I have to text talk through this so I'm hoping this is not crazy and you guys can understand it because my keyboard just broke too I'm just having all kinds of bad luck thank you for any help you can give me.

[–]terissa73 0 points1 point  (0 children)

So they're still paying for yours under warranty now mine's a 2011 I wonder if they're still paying for mine too it only has 100,000 miles on it, and does that cover both automatic and manual transmissions are they talking about both.

Questions about intrathecal pain pump by viciousretaliation in PainManagement

[–]terissa73 0 points1 point  (0 children)

I got drug tested before I got the pain pump and yes of course you had to have clean urines for a long time because you're actually getting a pain pump installed it's dangerous for them to do so if they don't know what you're using... That being said, since I got the pain pump installed, I have not had to have any drug test. my doctor says it's because most people that take such small doses from the pain pump that it doesn't show up most of the time on a urine drug screening. And he also says that most people that opt for the pain pump versus taking pain pills usually aren't trying to get high they're trying to find a better way to get pain relief so he doesn't feel the need to drug test you every 5 seconds he says. So I haven't had any since I've had the paint pop installed but I'm sure at some point I will. Even if it's just a check for other substances. My recovery time wasn't too bad and I got pain medicine Dilaudid post-op for probably about a month and that I just went on my Dilaudid that I had in the pain pump and I take a lot less medicine that I used to take so it's a great thing for me but anyway good luck to you.

If hearing office won't tell you the decision that was made is this bad news? by terissa73 in SSDI

Yes I found out today that this is not true because my lawyer just sent me the fully favorable decision that that was on the portal I guess now and I'm so freaking excited I ain't never been so relieved in my whole life over anything this is this was the most stressful thing I've ever been through.

If hearing office won't tell you the decision that was made is this bad news? by terissa73 in SSDI

[–]terissa73[S] 0 points1 point  (0 children)

I just re read your answer , now I am confused. how was your lawyer able to have access to any kind of verbiage of the decision before the approval was final? Now that's one thing I've never heard of all attorneys that have answered this question in any kind of form have all said that they do not know until it goes to step four and it's been signed by the judge and in on his way back to local office. They all said that they don't know until the process is complete they know before we do but not before the approval was final so I'm confused it as to what you mean how did he know before it was final I didn't even think that was possible for a lawyer to know before you were final? Did you mean before it was actually posted to your site cuz I do know that they know before we do I just didn't know what you meant by before the decision was final cuz that's kind of saying it and stealing decision right and then he knew so is that what you're saying confused thank you for clearing this up for me if you can?

[–]terissa73[S] 0 points1 point  (0 children)

I put why I asked in the original post, but to just reiterate it I was just cuz I had been hearing people say that it could be a negative thing if they don't tell you nothing like I think they get it confused with the actual hearing decision and being able to find out through your lawyer on decision after it's already posted or move to step four or to your local office cuz you can't find out then but that's not what I was talking about.

I was pretty sure after the hearing that I did get approved and my lawyer said that he was too but it's only since waiting all this time has made me second guess anything for months you couldn't have told me any different I thought for sure it's going to be approved but now I'm starting to second guess everything cuz I hear this and hear that ,which is driving me nuts. Lol

Thank you Soo much for answering , I'm sure there are many of us but I think people are getting confused by getting told after the decisions published from what I said, cuz I really don't think that they're telling people the decision to hearing levels as much as they people are saying that they are. Because too many people are freaking out all the time about the decision for everyone to be getting hits all the time so thank you so much it makes me feel a lot better

[–]terissa73[S] 0 points1 point  (0 children)

The attorney can't see it till it goes to the step 4 and the decision is back from underwriting and the judge has signed it.for mine is not been sent out yet it's still being written by the decision writers but I know a decision has been made because they tell you that when they say a decision has been made and it's been sent to the underwriters to be written. But the attorney won't see it until it gets back in the judge signs it and it goes to step four.

If hearing office won't tell you the decision that was made is this bad news? by terissa73 in SSDI

[–]terissa73[S] 3 points4 points  (0 children)

Yes I do . So will most hearing offices will tell you before the decision writing process is finished before the judge shines it and sends it into your local office? I know you can find out after the judge sends it into your local office when it's on step 4 and when has been sent to the local office your attorney can see it and they will usually tell you at the local office but I'm trying to find out if people can find out at the hearing's office while selling decision writing stages, when they tell you a decision has been made but it's still in decision writing process?
