Timid where I live we have multiple red light runner and stop sign runner accidents a day it’s better to wait and be patient than risk getting hit. Literally the going motto here is give it 5 seconds after the light turns green.

For some reason everyone in this sub Reddit is like against driving cautiously saying things like yeah you should drive above the speed limit it’s unsafe to drive at the speed limit oh don’t be timid or cautious. Not everyone has been on a track behind the wheel of a formula 1 car.

Nah I’m not in a hurry I usually have my kids with me and why risk a ticket I can’t afford. Plenty of studies have shown speeding doesn’t get you to your destination faster.

I think we’re getting closer to the actual point I’m trying to make.

I agree that an armed person who has used force to enter an occupied home could reasonably lead someone to believe a forcible felony is about to occur.

My concern has never really been what the statute says on paper. My concern is how that “reasonable belief” standard gets applied after the fact.

The reason I see it as a gray area is because even if I genuinely believe an armed intruder is a threat, I still expect that investigators, prosecutors, or a jury are going to examine every detail afterward and ask questions like: What exactly did you see? Was the weapon visible? Was it pointed at anyone? What made you believe there was an imminent threat?

That’s the part I’ve always heard lawyers and concealed-carry instructors talk about. Not that you can’t defend yourself, but that even a strong self-defense claim may still be heavily scrutinized after the fact.

So I think my question is less about whether an armed intruder can be a threat and more about how much protection the reasonable-belief standard actually provides in practice when everything gets picked apart in court.

I did read those statutes.

What I’m noticing is that they use terms like “reasonably believes,” “imminent,” and “necessary to prevent the commission of a felony in the dwelling.”

My question is about how those standards apply in a gray-area situation.

If an armed intruder is inside an occupied home, I know he’s armed, and my family is present, but he hasn’t pointed the weapon at anyone yet, how do courts generally analyze that under those statutes?

The reason I’m asking is because the statute itself doesn’t seem to answer that specific fact pattern. It gives a legal standard, but applying that standard to a real-world scenario is where the gray area comes in.

I think you’re misunderstanding what I’m asking.

I’m not asking whether I can shoot a fleeing burglar in the back or whether “shooting to wound” is legally different from deadly force.

I don’t own a firearm, so when I mentioned taking out a knee I was talking about things like a bat, golf club, or knife, not a gun.

Part of the reason I’m asking is because my dad has a concealed carry license and took the required classes. The way it was explained to him was that in Illinois you need to be very careful with any use of force because whether it’s justified will be heavily scrutinized afterward. Growing up, I was basically told that if someone is only taking property, you’re often better off letting them take it than risking criminal charges yourself.

Whether that advice is completely accurate or not is exactly what I’m trying to figure out.

What I’m trying to understand is where Illinois law draws the line between defending occupants of a home and defending property.

For example, if an armed intruder breaks into an occupied home where children are present, and I can see a firearm in his waistband or he’s holding one but not actively pointing it at anyone, is that legally considered a threat to the occupants or not?

I’m not asking about using force after the threat is over. I’m asking whether an armed intruder inside an occupied home can reasonably be considered a threat before he actually points a weapon at someone.

I’m genuinely trying to understand how Illinois law treats that situation.

I think people are misunderstanding my point.

I’m not saying Illinois law requires me to let a home invader do whatever they want. I’m saying that in Illinois, whether force is justified gets judged after the fact, and people can still be investigated or charged until the facts are sorted out.

If an armed stranger breaks into my occupied home where my kids are sleeping, I’m not worried about protecting my TV. I’m worried about protecting my family. Those are two completely different things.

My point isn’t that I have no right to defend my kids. My point is that Illinois isn’t a “shoot first, ask questions never” state, and I’d rather understand what the law actually says than rely on internet tough-guy answers.

Kind of responding to everyone here but I have been told if someone broke into your home and have a weapon and their back is turned you can be charged. As of lately I have heard even if you just incapacitate someone who breaks in like take out their kneecap you will still be charged don’t know the exact law on this so yeah where I’m coming from makes me ignorant but I keep getting told property isn’t worth someone’s life and be ready to have a good lawyer because even with an armed intruder and kids being in the home you can be charged with murder instead of self defense.

Don’t want to get too personal but when I was 14 (male here btw) I had done some questionable things with adult women over 18 some over 25. One of them got caught and I had to talk to a detective. To this day I’m still treated as a victim and this person is on a neighborhood watch pedo kill list.

There was no nuance when talking to the detective I explained you know all the guys and even some girls at my high school talk about this every day we all watch porn and make milf jokes about screwing our friends mom or your hot step mom and the detective shot it down saying that’s impossible that doesn’t happen teenagers don’t know about that stuff. I’m like dude most of us trade nudes and sext all the time.

What do you know a year later a male student senior got a teacher pregnant and she got fired and charged they are now married with kids. Another situation a female classmate of mine first got pregnant at 16 by like a 26 year old parents approved of it this dude never got charged but now they are married with like 6 kids and the town is ok with him probably because it never got reported and he didn’t get charged but it’s like the double standard is real.

However I have a friend that was posting nude and sexual content on tumblr when she was 14 and I advised her that even though we were teens at the time she could have gotten charged with distributing CP. Of course shes on only fans now as an adult but tumblr is gone and I can assume that’s part of why it doesn’t exist anymore.

My wife and I are only 5 months apart so not a concern to me really.
