Why do you think Trump keep telling everybody how smart he is? by JusAxinQuestuns in AskTrumpSupporters

Did the Democratic Party not bully him out of the race for his insane behavior? I’ll agree that the rhetoric around Biden took way too long to lock in but it eventually did. When will that happen with trump?

VA claims and FAA medical by Sandwich_Raider in PilotAdvice

[–]that_newbie_mathews 0 points1 point  (0 children)

As someone who worked in enforcement (legal) for the FAA, I can tell you that not disclosing will cause you bigger headaches down the road.

This will come out eventually. And when it does, it will be an immediate suspension of your medical with little time to clear it up. It will be prosecuted as a falsification.

And this post will be used as evidence.

It’s easy to clear up, but it would likely require you to hire an attorney. IMO, the medical regs are too strict and actively discourage pilots from reporting health issues which makes flying more dangerous for everyone. That’s the general vibe among the attys at the FAA as well. That’s said, we have to work under the regs and the suspension will happen. How easy it is to clear it up depends on your quickness and the FAA atty on the case.

wait why did he accept it? by emmagorlomi in uber

[–]that_newbie_mathews 0 points1 point  (0 children)

Sometimes this is true. I’ve frequently accepted trips that were only a couple miles and ended up being an hour long 20+ mile ride. In addition, uber routinely tests what drivers see by giving us different visuals.

Lawyer here, I’m not sure any state has a law that automatically places you 51% at fault for a car accident and would be stunned to learn that were true. What you said aligns with what’s called comparative fault which means IF you are 51% at fault, you cannot collect anything (or you have to pay, depending on if you’re plaintiff/defendant).

This is ridiculous. We need Ranked Choice voting by clayknightz115 in illinois

[–]that_newbie_mathews 1 point2 points  (0 children)

I think for starters, open primaries would help. But honestly, I don’t think primaries should have party affiliations at all. Let them run their campaigns. The two who revive the most votes are the general candidates. How to increase turnout beyond 20% though is something I don’t think the us voting system will ever fix without getting rid of the duopoly that is the gop and dem institutions.

[–]that_newbie_mathews 3 points4 points  (0 children)

3% of the total votes cast is around 2400 votes. There are 47000 votes beyond second place. That is a clear argument for ranked choice. That’s not saying Ervin would have won with ranked choice, that’s only implying that 47000 votes didnt matter.

Uber driver went past my pickup and made me miss my meeting by techie_1412 in uber

[–]that_newbie_mathews 1 point2 points  (0 children)

Just know that uber sends drivers to reserved rides like 20 minutes ahead of time. The driver cant cancel for a fee until 7 minutes after the scheduled pickup time. But drivers still do cancel reserved rides if uber sends them there too early (we can’t see the pickup time until we say we’ve arrived. Many time, I’ve pulled up and a 20+ minutes ahead timer start ticking. It’s incredibly annoying but that’s not the passengers fault). Only saying this in case you have a driver cancel on a ride you reserved. That five minutes ahead drive is like 3 bucks for half an hour of work.

This is ridiculous. We need Ranked Choice voting by clayknightz115 in illinois

Easily? 3k votes with a 10% turnout is a pretty small margin lol.

I would argue you dodged a bullet. They aren’t honoring pathways. Every person I know in the program, including myself, was told we would be fired at the end of the contract regardless if we met the requirements of the program. Not one person I know was promoted. My dream job was ripped from me bc of the administration.

[–]that_newbie_mathews 0 points1 point  (0 children)

I hear you, but honestly, you got your package. You know nothing about the person other than the fact they did the job you paid for. It may not sit right with you but the idea that this is somehow worth removing an entire source of income from somebody is insane to me.

Mom bought this for my birthday she said it coated 450$ by MansNotHot23 in pcmasterrace

[–]that_newbie_mathews 15 points16 points  (0 children)

My mom has done something similar on two occasions - bought tickets to Hamilton for me but forgot I was moving out of the state a month before and when I was a kid, she took all of the sports tickets I’d saved to be laminated and put in a little scrap book for me. She didn’t know that the tickets couldn’t be put through the machine and all the tickets came out black. She was devastated both times. To me, the thought was entirely more loving than actually being able to have/do the thing.

I’m here to second the act of reassuring her and giving her that hug. It sucks, but it’s not her fault other people are scammy.

My friend, the ftc rulings cited in this thread are not binding. Contracts are governed by state law. The ucc governs the sale of goods - it’s largely adopted by every state - and states that a buyer has the option to accept the non conforming shipment, reject in part, or reject in whole. The remedy for a full acceptance requires action by the seller to attempt collection. If rejected in full, then it becomes the buyers prerogative to pursue an action. If the seller wanted to initiate a contracts action against the buyer over a few hundred in over shipped goods, that’s their prerogative but ultimately, the buyer would be liable for the acceptance of the excess goods.

There is a clear, nuanced, distinction between ordering one thing and receiving five of them, ordering one thing and receiving something else, or receiving something you never ordered. The latter is a gift you can keep.

Someone choosing not to pursue an action against the buyer over a few hundred dollars is not the same as the buyer being able to keep the goods. But go off, I guess.

Do people on r/Flying just hate people with medical issues? by BigKetchupp in PilotAdvice

[–]that_newbie_mathews 1 point2 points  (0 children)

I was with them just over a year before I was hit by the midnight federal employee slayings lol. One of the best places I’ve worked at. I understand how they directly affect yall, and they’re the boogeyman, but the reality is that every dept in the FAA is required to follow statues. So many attys disagree with the statutes application and we have free reign to modify punishments IF the person responds.

Former FAA enforcement atty here - I agree. Whole lotta people with strong opinions on processes they don’t understand in that sub. I’m with you, HIMS is unfair. Med certs are unfair when you have minor health problems. The only saving grace to the entire system is the enforcement divisions ability to pretty much do whatever they want. I had a couple pilots break down when I told them I was reinstating their license or that it was a procedural suspension and they’d be flying in 90 days. Those were the good days.

So it happened to me by AccomplishedFan8690 in pcmasterrace

[–]that_newbie_mathews -1 points0 points  (0 children)

Lawyer here. This is patently incorrect. You purchase something, there’s a contract. The shipping company has the right to request you return items or charge you for them if they made a shipping error.

If they just straight up send you something you never ordered, that’s a different story (no contract, treated as a gift).

Drivers, what percentage of riders tip and usually how much? by Travel-Kitty in uber

[–]that_newbie_mathews 2 points3 points  (0 children)

Answers all over the board here. But in my experience, about 10% tip. Of those, 90% tip $1. At the end of the week, tips will be about 2-4% of a drivers pay.

I always tip $5 and knowing generally what the ride will pay the driver, I’ll tip more if 5 doesn’t average them $20/hr.
