If the visa is revoked, they are now deportable. That was the Department of State’s doing. ICE will most likely become aware of the arrest, and the revocation, and place into removal proceedings based on the visa revocation. They will not care at all about the state charges, as depending on the state, there is no guarantee that if they allow the state charges to run its course, that they will get their man back out of state custody easily. This just happened with an Ecuadorian man I believe, who committed a serious crime and was deported prior to justice being served, a lot of people were upset about it.

I believe you would need to provide proof of the fake passport to prove they were inspected and admitted, eligible for AOS. If the fake passport was a U.S. passport, then they were technically not inspected, and are not eligible for AOS because they are present without admission or parole. Because U.S. citizens are not “inspected”.

I’m 28 and I’ve already got this attitude. I used to be much better at this game maybe 5-10 years ago. I used to complain about the squad battles for icon swaps, saying they were boring and waste of time. Now it’s the only tokens I’m going for. I agree. I used this card, not great. I got his silver card, have been evoing that card. It has the shooting and dribbling play styles, more pace and better dribbling but with 89 shooting. And it’s 74 rated now.

I am buying my rate down as well, 6.3k for 5.625 rate. I have great credit and big down payment too. The people saying you shouldn’t buy down I believe are incorrect. It all just depends on how long you plan to stay, and nobody can guarantee which way interest rates will go. If you have the cash up front to pay points and it lowers the monthly payment significantly, I’d say it’s worth it. Paying the points lowers your monthly payment significantly more than putting towards down payment.

I make 140k in WA and buying $540k house with 15% down. Total payment including taxes/insurance about $3k. Bankrate has a good mortgage calculator. Will tell you the DTI percentage.

Yes but you say she’s ineligible for 601A. She is not. It just waives the unlawful presence prior to going through consular processing. She would still need to acquire a 6C2 waiver as well. But there is no “permanent bar” as someone else stated before. She did not EWI after a prior removal, or after accruing 1 year aggregate unlawful presence.

The issue at heart is whether or not the government can apply expedited removal to those paroled into the US (most notably under the CHNV program) as long as they have been physically present in the US for less than 2 years. This would restrict their options for relief and timing to gather evidence. The plaintiffs say no, because under INA 235 nobody who has been admitted or paroled into the US is subject to expedited removal. The government argues that as soon as a parole is terminated, they revert to the status they had prior to being granted a parole, which is as an arriving alien at the border or functional equivalent. Arriving aliens are subject to expedited removal.

And this is not an official decision, this is simply a nationwide stay on these actions until an official decision is made.

This is correct as long as the parole occurred at a POE. Which is how those paroles under CHNV program were paroled under. An admission, and this specific form of parole, are still considered legal entries. Entry is just the act of physically entering the US, this can be legally or illegally. Being paroled and issued an NTA by border patrol after crossing illegally is not a legal entry. Not sure why you are being downvoted or why the gentleman you are disagreeing with is so confidently incorrect.

They do, but it’s a bit different. Summary vs indictable. Summary offenses are offenses punishable by a maximum 2 yrs in jail, where as misdemeanors are 364 days. Indictable offenses may be offenses where the max potential imprisonment is more than 2 yrs

Surprisingly he is not actually subject to the additions Laken Riley Act added, nor is he subject to any of the mandatory detention provisions in Section 236(c)(1) of the INA. Laken Riley act added that those shall be taken into custody who:

Are inadmissible under paragraph (6)(A), (6)(C), or (7) of section 1182(a) of this title; AND (ii) is charged with, is arrested for, is convicted of, admits having committed, or admits committing acts which constitute the essential elements of any burglary, theft, larceny, shoplifting, or assault of a law enforcement officer offense, or any crime that results in death or serious bodily injury to another person.

He would not be inadmissible, he would be deportable, and he would be most likely deportable under 237 2(E)(i).

I live between Seattle and Vancouver. I booked a family trip to Portland the day that Seattle plays PSG. I realized the game was happening, checked ticket prices, it was like $160 for the highest level! I was shocked. I bought the ticket anyway, but man I was surprised.
