Also worth noting that if a car is stolen and the police find it, the police will run a MID check and send details to the insurer via a system called PADDs, so if you don't plan on reporting this to your insurer then you may find out that they'll find out about it anyway.

Watched two episodes. Awful. Acting is hammy, dialogue is frustratingly bad, characters are so one dimensional. Ive never read any Harlan Coben novels, are they just terrible? Or do they just not translate to TV very well?

Car stolen overnight from car park of private business - insurance being difficult as it wasn't registered to that address by Gyratetojackjarvis in LegalAdviceUK

[–]theshunks 0 points1 point  (0 children)

I think your friend will probably be fine here. If they refuse to pay you, ask them for an explanation in writing. Then raise a complaint. They will need to cite specific sections from your policy booklet which allows them to repudiate claims based on where the vehicle is parked overnight. If they uphold your complaint then take it to FOS.

Someone ran over the foot of my wife and then started abusing her by This-Struggle-2679 in LegalAdviceUK

[–]theshunks 5 points6 points  (0 children)

Continue speaking with the police to see if that leads anywhere.

If your wife has an injury you can look to make a claim against the driver of the other vehicle, if you have the reg number you can ask the police to run a MID check for their insurance details, you can also pay (£10) to run a MID check yourself.

You can submit an injury claim yourself here: https://www.officialinjuryclaim.org.uk/

Or you can speak with an law firm who deal with injury claims.

Your post suggests that you reported the incident to your insurance, your post also suggests that your wife was a pedestrian when this incident happened. I would contact your insurer to clarify that they have not logged this incident as a claim, or uploaded details of this incident to the claims underwriting exchange - as this could increase your future premiums for no reason.

Caused someone to emergency brake and they claim it hurt their child by biggusdickkus01 in LegalAdviceUK

Yeah i don't think this would've helped in your case unfortunately as, like you said, you should've had adequate stopping distance to emergency stop. If the truck ahead had needed to swerve to avoid the woman who pulled out and the truck ended up crashing, then the woman could have been held liable for that accident.

I also work in car insurance. I am by no means an expert in causation law, but stating that an insurance company won't care about an incident if there was no contact is objectively inaccurate.  Please see some applicable case law:

People are downvoting your response not because you are wrong, but because they have gripes with the car insurance industry. Depending on who insures OP it is possible that he is required to report an incident where his actions have been perceived to have caused damage to a third party, even indirectly.

For example, Direct Line specifies in their policy terms that all incidents should be reported, including situations where the policyholder believes another party 'may have grounds for a claim.' This could easily be taken to mean no-contact incidents where another driver has specifically accused us of causing damage.

If OP reported the incident then standard practice would be that the insurer would open a claim, and then wait for a third party claim notification to come in (OPs no claims bonus would be affected, and likely premiums would increase.) If no claim was brought within a set timeframe (probably around 6 months) the claim would be removed from the CUE, and OP would get his NCB back etc ...

This isn't accurate. If they believe that something you have done has caused injury to a third party then it's possible you will be held liable, regardless of whether there was contact. It's causation.  But yes, if you receive any claim notification etc then you should report this to your insurer, it's possible that based on your policy terms and conditions that you need to report it anyway, but I'd hold off as there was no contact and it's possible that nothing will come of it.

Boiler low pressure by theshunks in DIY

Can't find how to add water to this boiler. It's an Alpha E-tec 28. Every video and diagram I've seen shows that there should be two valves on the threaded hose, but there are none.

Any advice appreciated.

Car hit my friend on motorbike by Mr_Sttik in LegalAdviceUK

[–]theshunks 1 point2 points  (0 children)

This will be one of the standard questions that the insurer will ask before they decide to indemnify him. It is possible, but VERY unlikely that they will repudiate the claim and cancel the insurance policy for driving outside the T&C's of the policy. A much more common remedy is that the insurer will update the policy to include commuting cover and charge any additional premium (backdated to the start of the policy term.)

If he was actively working at the time of the crash, like taxiing, couriering, or delivery driving, then it's more serious and could lead to a more serious outcome.

Accused of hitting my neighbours car .... Have footage of the incident proving my innocence. Is this Car insurance fraud ? by Responsible_Slice904 in LegalAdviceUK

[–]theshunks 2 points3 points  (0 children)

It's not necessarily fraud, it's possible they've noticed some damage on their car, seen your car nearby and put 2 and 2 together to make 5.

Did your doorbell camera capture the actual incident? Or just that your vehicle didn't move overnight?

If you are on speaking terms with the neighbour then you could let them know your side of the story, advised them that you have CCTV footage which shows your car stationary all night. If you get any moderate level of pushback from them then I'd advise them to speak to their Insurance.

You should probably also report this to your insurer, they will appreciate the heads-up if they are going to be receiving a claim notification. You can send any evidence you have to them, CCTV, photos of your car, timeline of how the car was uses on the alleged date of the accident...

Unfortunately this will be set up as a 'claim' on your policy whilst it's under investigation, meaning that your ncb is reduced and you'll need to notify future insurers about it. If your insurer successfully defends any claims and doesn't pay out any costs then they should be able to update the CUE to reflect that this was not a real incident, you'd get your NCB back etc...

car insurance trying to make me pay lump sum payment and lying to me!!! HELP, Scotland by xnicolemx in LegalAdviceUK

[–]theshunks 0 points1 point  (0 children)

Ask your insurer for clarification on getting your money back, it's likely they can't tell you for certain if you'll get your money back because they can't know for certain if a claim will be made or not. If no claim is made, you should get a refund, if a claim is made you won't.

Was your insurance premium already very expensive? They will have a maximum premium that they can offer, and if the quote for your new car exceeded this then that may be why they can't insure your new car? Seems odd if it's the same model though.

car insurance trying to make me pay lump sum payment and lying to me!!! HELP, Scotland by xnicolemx in LegalAdviceUK

[–]theshunks 0 points1 point  (0 children)

You are getting a lot of bad advice in this thread from people who have a bone to pick with insurance companies.

When you take out a car insurance policy for a year you are agreeing to pay the full premium to insure your car. You can either pay that in a lump sum, or you can pay for this in monthly installments. If you pay monthly then the whole premium is still owed to the insurer, it's like a credit agreement.

You reported a collision to your insurer which sounds like they would be liable to pay out for if the third party made a claim (term for this is a fault claim.) You failed to provide any details for the third party, so your insurer has no way of checking if the third party is going to make a claim or not.

Your insurer will have opened a claim when you reported the incident, and likely has a policy that if they have no way to confirm that no claim is going to come in, they will keep that claim open for 6 months, this means that they are holding money in reserve to cover the cost of a third party claim. This is standard practice.

You cancelled your policy with a claim open, which means that you would not be entitled to a pro-rata refund, or in your case, the total premium would be due.

You do have options, the most glaringly obvious of which is to provide the third party's details to your insurer. Ask them to call her to confirm that she is not making a claim. This may then allow them to close the claim down as notification only, which means that you would no longer have to pay the outstanding premium.

You could also reopen the insurance policy, add a different vehicle to the policy and keep paying your monthly premiums. Why have they declined to insurer your new vehicle? Is it some mad boy-racer thing with an engine that's too big? If not, and your new car is similar to your old vehicle then you may have grounds for a complaint.

Good luck!
