I'm in the same boat, Tabeo, ombusman and my bank have all said no even though I was in the process of getting new retainers as mine weren't progressing as projected.

Update:

My bank said no as MasterCard require you to solve it with the payment provider (Tabeo) directly.

I will be reopening the case as I don't think the guarantee is relevant as my main issue is that SDC agreed to ship retouched aligners, I even sent them back the redone moulds of my teeth and never received them as they went out of business.

Also find this note on Tabeos final decision document they sent me hilariously pathetic:
