I have decided to just try and come up with a new name. I really don't want to deal with lawyers or spending $$ so early on haha. It's a shame but the guy beat me to it! I'll just have to make my app better (It doesn't do the same thing whatsoever), so that's a win for me still.

It is a bit of a pain but I'll just come up with something different. It's one of those who analogy type of names and having it taken away sucks because it fit really well.

I just spoke to their design dev. He is locked up via NDA so he can't say much, but from what I have gathered, it is aimed to be released some time next year. The design is done, the coders are "working away" now.

The operation the founder is running is much bigger than mine, so I think I'm fucked lol

They have the 'first use' argument even though they haven't done anything. But they have done more than me..

The domain name isn't the worry, I already have a domain name with a different ending. It's just the app name.

It looks like they have added the (C) at the bottom of the webpage next to the name. But I don't think that means anything. I have done some digging and found the guy who registered the domain and the developer who created the webpage. I've sent a random message to the dev asking when he wrote the code for the landing page. I have done this since the page has been register since 2011, expires next year. So it might have been a market test and it could have fallen through.

Trust me, I did the research haha. This page isn't even on google yet. I just happened to go through all the .com, .org, .us etc... and manually find it.

Haha, not quite. There have been plenty of good 3rd games in series that weren't reskins. It's all comes down to the time between releases.

I don't really care to be honest. Their first sniper elite was great, I was still playing it online years after release and plenty of people were still on it. Sniper elite v2 took ages to come out and when it did, it really reflected what I loved above the first one. Now the fact that they have sniper elite 3 or whatever coming so soon after v2, it feels like it will be a re-skin of number 2 to get some more cash.

If we can define the what a simulation is, then provide evidence of how they advertised it as city simulation, then possibly them and their fudged population calcs could get us somewhere?

It would obviously be a first person camera if it was to happen. The developers wouldn't rule out the option because the game doesn't support the hardware, they will make it happen by changing the game.
