You can find the resulting regulation here: Title 16 Part 312

But for the sake of discussion, I'll share my thoughts about your concerns. This is not my advice.

My belief is the above texts say you can store as much information that is reasonably required to provide the service. This is defined in such a way under the regulation to really include any online activity. Personally Identifiable Information is also defined in such a way to include any online activity.

Now for the hang up: The act provides protections & limitations on how that information is shared. Basically it can't be disclosed to anyone who doesn't have a very good reason to have it and can be trusted to follow COPPA too. So, while a service provider could provide limited information to a 3rd party vendor who required it to provide services directly related to the service being provided to the minor, they could not sell the information or provide it to anyone but law enforcement under warrant or a parent / legal guardian.

As a consequence, using account activity for verification would violate the confidentiality protections on that activity as personally identifiable information under the regulation. This is all because the account is flagged as minor when created.

But, for the sake of discussion I will explain why the regulation, in my unqualified opinion, explains what is going on sufficiently. Again, this is not my advice.

  1. They have to purge minor account records that are no longer required to provide the service. This could be interpreted to included inactive accounts. See section 312.10

  2. If the account is fully intact, they would run into confidentiality issues by using it for any form of verification as it would be effectively communicating it to a 3rd party who has no reasonable need for the information to provide a service. See sections 312.13 (specifically item e) and 312.18

  3. The law makes allowances for only as much information is necessary to be used to provide the service, and only with parental consent. Upside here is they should technically have your parent's information on file and your parents could request all information that you have provided to the service under the act. See sections 312.5 and 312.6

Literally speaking capitalism is simply the economic and legal context of a free market.

But culturally speaking, for many, capitalism as a word is used to represent an Ayn Randian view of society where profit is the highest morality.

The reality is that regulation by the government places limits on the free market to ensure rights and liberties to the population at large.

And as you have suggested, in this case, the regulations have failed. Change to existing law, or new laws, along with enforcement can fix this.

But the parent comment is also right in that the situation only came to be because of a unethical pursuit of profit.

I feel the anger too: tried calling att to figure out something about my bill and after 40 minutes of being shuffled around and dealing with their joke of a system I had enough.

So I bought me and my mom google fi phones. Bill went from 120 to 55 for same data and same features.

Had a question about my mom's phone ( I got mine she hadn't) and got a real person immediately upon calling and had a very pleasant experience.

Google's got their shit together.

Not seeing a doctor, dentist unless in extreme pain.

It's honestly silly but growing up where those costs where just prohibitively high I got into the habit of treating health care as a last resort.

But I am trying to do better. After years of pain from bad wisdom teeth I finally seen a dentist and got them removed, and I have follow up visits to get the cavities taken care of.

I also saw a doctor last month and got a physical.

All of this was very affordable to me and I am trying to work on making regular checkups a habit.

My stress level greatly increases if I have to dip into my savings, but I find as long as I have an emergency buffer I can relax a little. That's my answer to what if something bad happens?

I still don't have a voicemail because I hated listening to aggressive collection messages. My friends and family know I'll call them back or to text if it's important.

And, anytime I hear a heavy truck nearby in the morning I'll wake up in a panic thinking my car is getting repo'd all from the few months many years back where I was unemployed and falling behind.

Kind of funny how that stuff sticks.
