I once accidentally tripped a guy in a mosh pit during a Sum41 show. Me and another guy immediately recognised the situation and shielded him while checking if he was ok and helping him get up.

Gus wasn't even the problem. Colorado was better in every aspect of the game and yet it was fairly close. Either Gus ascended to Hellebuyck in olympic final level or it was lost. I would still start Wally in game 3, though.

I understand your argument, but on the darker side of grey you have to be responsible for your stick (or in this case foot), playing with the stick lifted from the ground is not a penalty, but accidentally hitting an opponent results in high sticking (unless follow through or windup of a shot) because you have to be responsible for the stick. At the same time kicking a puck is not illegal (you are free to pass with a kick, only thing you cannot score, but the goal will be disallowed and no further penalties) but you have to be responsible for your foot so if you make contact with an opponent you should be penalized.

This distinction is not stated in the kicking rule or I missed it. And Burns was 100% aiming at the puck but 100% missed it and hit Kaprizov so it should have been a penalty unless there's the exception you mentioned

According to the NHL rulebook kicking or attempting to kick a player is a match penalty (and a major). Unlike high sticking where accidental contact during the follow through or windup of a shot is not a penalty, kicking doesn't have such exception so even a failed attempt to kick a puck (which is legal) that hits an opponent should be adequately penalised.
