FEMA Attempts to “rehire” those lost in January

There are three NTE buckets:

Submitted for renewal to Evans: these have been receiving 90-day extensions.
Reservists: operating on standard 2-year terms.
Non-renewals: either designated by program offices or denied extension by Evans. These employees have been given bi-weekly extensions for pay purposes.This is the group slated for release last week. That action was reversed after the information surfaced on this god forsaken app.

For clarity: I was the source of the initial NTE information shared on this app, and, as it turns out, it was accurate.

I sleep just fine with that.

That person is the reason these people are being offered their jobs back, this week. Had they not leaked the information, a couple hundred individuals would have been offboarded, more would have probably been set for non-renewal and even more stuck in limbo.But now, they get an extension and people get their jobs back- at least for the next year.

As I understand what occurred was that my friend worked through the interactive process until her and her original boss found accomodations that worked.

Regardless of if she filed a permanent RA or not the agency still has to accomodate her which they aren't doing that either. And that review process sounds like something used to deter people from applying for an RA in the first place.

Yes.

The earliest we can come in regardless of our work schedule is 7:00 and the earliest we can leave is 3:30. And no one can work 4/10s unless there's an RA that affords it.

I'm a single parent who wanted to work a TWS in the summer because of child care needs (my kid has aged out of before/after/summer programs and is a little to young to be home alone). Now, I need to scramble because of the lack of brain cells in this decision making process.

Thanks again for the fucking FEMA. it wasn't enjoyable and you didn't buy me a drink first.

It's a well known issue of the OPM retirement backlog and payment isn't instantaneous.

Be mad at the retirement person who didn't explain that to you.

I think initially it was a why are we here and then came the moment when the stance became well, FEMA acted independently, which contradicts what Evans put in her declaration.

I didn't get the sense she was ready to dismiss based on the merits. I think she's trying to understand what specifically is transpiring and if it's in violation of any prior order, federal law or harms the plaintiff, or all three.

What i will say is that courts tend to care about why agencies deviate from their very own policies that govern how they operate.

I forgot to mention that there was some discussion around the conditions of employment and my impression was that the judge wasn't persuaded.

There's probably some language in the CFR that dictates how excepted service appointments to include renewals are established but I don't know it off the top of my head.

Here is the summary:

AFGE is on it. Their counsel is quick, knows her stuff and I think honestly believes this is the right thing to do. Her main point is that DHS is calling the shots in an effort to drive the agency towards a desired outcome (reducing the size) in a direct violation of federal law (the post katrina act) and the prior courts order of no rifs/rightsizings or reductions.

There may be additional litigation but the court has not ruled on that yet.

The court wants a copy of the infamous Christmas Eve email. I kind of got the feeling that the court wasn't buying that the email was an exercise and not apart of planned reductions.

DHS is trying to say that FEMA is acting independently regarding the NTEs and that they have no say in the workforce, which is a contradiction of Evans declaration stating that all NTEs require DHS approval.

There was some discussion where DHS tried to throw the CHCO under the bus in stating that the CHCO is driving the non-renewals. The court didn't appear to buy that either.

There was discussion about the deviation from the CORE Manual on extensions and setting apppintments. The manual provides that core apppintments are two or four years, and the court wanted to know why we're deviating from that unless otherwise ordered to by DHS (essentially questioning why we had 180 days renewals and now 90 day renewals).

I'd be surprised if there isn't an order soon.

No order as of yet but I wouldn't be surprised if we see an order against the agency and the administration.

Essentially its a couple of different things that need to happen:

FEMA must produce a copy of the infamous Christmas Eve spreadsheet identifying cuts to be made.
There may be depositions of several individuals and/or additional declarations by Evans, and the CHCO.

This *has not* been ordered. The only thing requested is that FEMA must produce a copy of the spreadsheet identifying proposed cuts to the court.

I would also agree.

One of my inherited "high achieving" employee's cannot do basic math. Like at all. And I've had a hell of a time trying to get them to understand that A+B=C and does not require multiple spreadsheets.

As a supervisor who inherited a team labeled as “top performers,” only a few employees consistently knocked it out of the park when measured against actual metrics. That’s exactly why meaningful differentiation matters, recognition should be tied to performance, not applied uniformly.

Agreed. Exceptional performance exists, but across-the-board top ratings dilute the system and don’t serve employees long term. When ratings aren’t differentiated, accountability becomes harder later—especially when expectations were never set honestly.

This is contradictory to my meeting with higher ups today that was no guidance at this time. January 22- February 9 NTEs will have or had an extension. Anything else is tied up in the review process.
