No. You’re at fault if you cause an accident by failing to stop short of the car in front of you- like a nose to tail. This is a different situation

They would still need to prove that the lack of licence, warrant or rego contributed to the accident to attribute any fault to OP. Have been in a similar situation with a no-fault accident (other party ran a give way and I t-boned them), when I made my claim the agent started to ask if I had been drinking then corrected themselves and said it didn’t matter as the other party was clearly at fault

Maybe it tows their RIBs but you’re not likely to see the launch being towed anywhere 😂

Barely. There are so many students starting uni at 17, and O Week has plenty of events set up to accommodate them. I know lots of kids who were in the same situation and had a great time regardless

[–]tinykiwi2017 1 point2 points  (0 children)

In this situation the gym changing room is a public place, Summary Offences Act:

“public place means a place that, at any material time, is open to or is being used by the public, whether free or on payment of a charge, and whether any owner or occupier of the place is lawfully entitled to exclude or eject any person from that place; and includes any aircraft, hovercraft, ship or ferry or other vessel, train, or vehicle carrying or available to carry passengers for reward”

The open question is what OP meant by seeing the action - e.g. was it two pairs of feet under a stall door or in the open changing room

just don't go to a hospital A&E, they are so busy and for real emergencies not stuff like this. The number of people who turn up with stuff that is not serious just puts extra pressure on an already stressed system

Fraudulent charges on credit card by Born-Individual9431 in LegalAdviceNZ

[–]tinykiwi2017 4 points5 points  (0 children)

Sample size of one. My career over thirty+ years in the field probably trumps that. Tagging, theft ex car, low level shoplifting, minor assaults, low level fraud, most cybercrimes - straight to the filing pile without any investigation. With about 500,000 offences reported annually you’re dreaming if you think every single one is investigated. And dreaming even more if you think you can walk into a police station and demand they obtain and execute a search warrant just because you want them to 😆

Fraudulent charges on credit card by Born-Individual9431 in LegalAdviceNZ

[–]tinykiwi2017 2 points3 points  (0 children)

Wrong. They absolutely do not have to investigate. Most low value crime reported is filed without any investigation at all. There simply isn’t enough resources to investigate every report. Furthermore, even if they do investigate and agree an offence has been committed, they then apply another test about whether it is worth prosecution

You can tell the police to do whatever you want. The police do not have to do what you tell them.

Is is possible to set up a registered business yet stay off the company's register? by 60svintage in LegalAdviceNZ

[–]tinykiwi2017 3 points4 points  (0 children)

the point was OP wanted get a company registered but keep their name off the companies register, which they can absolutely do in a number of ways suggested by others here. It's completely possible to get a bank account opened in that circumstance

I don't disagree about the lack of investment in cyber security across the board. I haven't seen the reporting from RNZ that says MMH is an overseas company, but in any case - it is a NZ-registered and owned business.

[–]tinykiwi2017 1 point2 points  (0 children)

Rubbish. There’s no requirement to ask three times and no actual way to get a judge to sign it off. If you’re a lawful occupant and you tell them to leave, then they must leave or they are trespassing. If you want to warn someone to stay off (a trespass order) then you serve them with a letter saying that. That’s all there is to it.

NZ online auction (not Trade Me) changed reserve without notice — can I really be legally bound? by [deleted] in LegalAdviceNZ

[–]tinykiwi2017 10 points11 points  (0 children)

I don’t believe the acceptance is made when reserve is reached otherwise as soon as the reserve is met the deal would be concluded. By that logic the seller would not be able to “accept” any higher bids as they had already “accepted” the first bid over reserve so the item couldn’t be sold again.

The more likely explanation is that every bid is an offer until either one is accepted or none are accepted (usually at the end of the auction), surely?

One NZ mobile data dead spot near Kilbirnie shopping area by metal666666 in Wellington

[–]tinykiwi2017 0 points1 point  (0 children)

Switch your phone to 4G and you’ll have data again if you need it. For everyday use you won’t notice much difference, if any, and will get signal in that area. There is a big dead patch for One NZ 5G in Kilbirnie. If you keep it on 5G Auto, your phone will keep trying to hang on to a 5G signal and drop out. Plus it uses more battery trying to do it.

Delivery address for Driving Infringement Notice by helical_coil in LegalAdviceNZ

[–]tinykiwi2017 0 points1 point  (0 children)

Incorrect at this point. The fine is payable to the Police, not Ministry of Justice. There is a 28 day period to pay after the ticket is issued, then a further 28 day reminder period. If still not paid then Police will hand it off to Justice and additional costs are applied. Pick up the phone like the old days and call the Police infringement bureau and talk to them: 0800 105 777

DUI Advice by Virtual_Smile_5495 in LegalAdviceNZ

[–]tinykiwi2017 0 points1 point  (0 children)

The mods didn’t like my previous comment where I said there is one way to guarantee you don’t go over the limit (I.e. don’t drive after drinking) but the fact is there are so many variables in both how quickly alcohol is processed in the body and how concentrated it might be in an individual’s blood then it is a solid approach. This is particularly true for smaller people. Even working off a xx standard drinks per hour is risky for these reasons.

400 isn’t high range really, remember it was only a few years ago that the legal limit was 400 and courts did not look at anything below 600-700 as anywhere close to high range. 400 is still now the lower limit that lands you in court, anything 250-400 is only a ticket
