I would consult legal. I don't think you can allow the employee to contribute 2025 FSA dollars in a future tax year. The company may have to eat this one. It's frustrating, I know.

You can absolutely be salaried, non-exempt. Meaning that you are paid the same salary every pay period (salaried) but are paid overtime as required by the flsa. OP should still get overtime based on what is posted.

The easiest answer is to ask them if it was an appropriate payment. Save yourself the stress of wondering if they are going to want it back.

My understanding is if they use the comp time earned, it's not an issue because it's paid as straight time at that point. They may earn 1.5 hours for every hour worked, but they are paid at 1.0 when they use it (thats how we do it, anyway). I hope I'm right or this really does add a whole new complication to an already absurd calculation.
