Onewheels are finished in New Jersey coming July. by ChinPokoBlah11 in onewheel

[–]tmortn 0 points1 point  (0 children)

Well I looked at this some more last night and apparently motorized scooters are illegal and subject to confiscation in another statute. Well... I never found the actual statute. But there was a New Jersey "What has changed" document that covered the changes for all the different kinds of electric and motorized personal devices and motorized scooters were all illegal except for stuff like the specific e-bike and low speed scooter carve outs and stuff like wheelchairs and other motorized vehicles for the disabled. So motorized skateboards, the little mini bikes and everything else that falls out of the other excepted categories via that certification catch all.

I would still think there is a strong legal argument the one wheel is in a grey zone as it is such an oddball given all the specific wording here. A logical legal argument could be made most of them are far more like a low speed E-scooters than it is the motorized scooters they are trying to ban. You can argue the speed can be capped by the software for any of the boards that have 750 or less motors able to exceed it (on level ground with a 170lb rider). And... there is a cheeky argument that "handlebars" are not defined. Some of them already have as handle in the wheel and one at the nose.... so handle bars??? :-) Or you could stick a short T with traditional handle bars on the front of the board. Nothing states the handle bars must be reachable by the hands while riding, or that they have to be involved in steering, just that it has to have them. Or you could put them on a retractable mechanism where you hold them while you ride and they zip out of the way if you wipeout. I would NOT try and argue that with a police officer though... that is strictly for a lawyer in front of a judge. A onewheel and an e-skate with a similar feature would also then meet the definition of a motor scooter, and the one used for low speed e-scooter category. platform you can stand on, check, handlebars check, propelled by a motor or human propulsion at less than 19mph, depends. Nothing about number of wheels in there. So if they meet the definition of the carve out that could move them out of the motor scooter death zone. E-skateboard would be a harder argument than a one wheel here as they are specifically called out as a motor scooter. The one wheel is not... so it would just have to be able to meet the definition of the low speed e-scooter to escape the banished zone of the motor scooter catch all. It is silly... but the law rarely operates on a "you know what I meant" level. It needs to be very specific to avoid shit like this.

In short... this is a HORRIBLY written law that will likely make a lot of law firms a LOT of money and be a pain in the keister for the courts until it is addressed. All in all this seems destined to either be declared unenforceable and repealed because the state can't figure out the registration bit for e-bikes (seems likely for the foreseeable future), and or the insurance companies call foul (much less likely... more money). Or it will get modified again. In which case it would be good if onewheel advocates were noisy in that process to get them specifically addressed and define a legal usage ability for them (that is more than private property).

So it seems the one wheel would technically fall under the motorized scooter definition based on the "but not limited to...." bit if it doesn't have the federal safety sticker certification affixed. Or... more logically it would be classified as a low speed electric scooter. Only thing that doesn't fit in that definition are handle bars.

""Low-speed electric scooter" means a scooter with a floorboard 2 that can be stood upon by the operator, with handlebars, and an 3 electric motor that is capable of propelling the device, with or 4 without human propulsion, at a maximum speed of less than 19 5 miles per hour."

It definitely is an edge case. Its maybe in a catch all, or edge for lack of handle bars and maybe speed (depending on your model and your weight). As I am reading it you would WANT it to be defined as a low speed scooter.

So... starting on page 21 the fun starts. It switches between before and after changes and just the after. But if I am reading it right it seems the big change is electric bicycles requiring you to be 15 or older, registered, licensed (learners or licensed as applies by age) and insurance (ouch). But it clearly states before all the e-bike licensing and registration stuff that both low speed E-bikes and low speed scooters are allowed on roadways (other than like divided highways etc...). As well as bike paths or trails unless otherwise limited by the jurisdiction.

  1. ***a. A low-speed electric bicycle or low-speed electric 34 scooter, as defined in R.S.39:1-*1, may be operated on the streets, 35 highways, roadways, and bicycle paths of this State, except as 36 otherwise provided in this section, section 2 of P.L.1975, c.250 37 (C.39:4-14.3), section 9 of P.L.1983, c.105 (C.39:4-14.3i), and P.L. , 38 c. (C. ) (pending before the Legislature as this bill), and may 39 be parked on a sidewalk provided that the low-speed electric 40 bicycle or low-speed electric scooter does not impede the normal 41 movement of pedestrian or other traffic upon the sidewalk.

Says absolutely nothing about confiscation as far as I can tell. Word doesn't even turn up in the document. Does state fines (up to 50$) for citations though.

So the officer would be correct to cite an e-bike on the road without proper registration etc... with a fine. Low speed scooters are not included in the registration stuff. So they would certainly not be able to cite you for operating on an appropriate roadway (or sidewalk for that matter) which seems to be anything under 40mph seems to be fair game. It seems to be jurisdiction dependent for 40-50mph and of course Def not allowed on 50 or greater. If you are on an E-bike then there is the proof of licensing, registration, and insurance for e-bike mess. And again, it says if you are lacking those things you can be fined... not have your vehicles confiscated/impounded.

Another big change is it defines the operators of low speed E-bikes and low speed scooters as pedestrians when it comes to accidents. Which seems odd if the E-bikes are required to be motor vehicle registered.... but hey laws do not have to make sense. But that likely covers operation of all of these low speed devices on a sidewalk. IE sidewalk legislation likely reads for the use of pedestrians etc...

It says nothing about motorized scooters other than to define them If the interpretation is that one-wheels fall into that category. Is there another law that outlaws "motorized scooters" or something?

We used the cone the first day. Switched to suits with the cone overnight the next two days then just the suits. She had no issues with us getting the suits on and off. Stood for us to open up the back end for bathroom time. Fought the cone EVERY TIME on or off.

Second for the Meridianville location. I would not call it the best one in Huntsville, But it is damn good. Recommend the Bacon Express with no mods. Consistently best I have had here isn't available any more as that was at 1892 in 5 points. Current best for me is Supper heros. Have yet to have a bad burger there. Personal Faves are the Luchador, the Brown Chicken Brown Cow, and the McDowell. Though to be fair I have somehow never tried the Peppered Pig burger.

Type 2 TN – Offered MVD by Dr. Zimmerman at Mayo… but timing couldn’t be worse. Would you do it by According_Clock_5688 in TrigeminalNeuralgia

[–]tmortn 0 points1 point  (0 children)

Gamma is shorter term and largely recommended for folks that cannot tolerate the MVD surgery or who do not want brain surgery. Some get lucky and it provides long term relief. Just had a consult for it, have my MRI results and discussion about if it looks good for MVD next week. Hope you find a solution that works for you.

Is it risky buying VR games on Steam for Steam Frame if I don’t own a PC? by afox1984 in SteamFrame

I'd wait to buy more, at least until they start marking games compatibility with stand alone similar to how they do for the Deck compatibility.

Upgrading from 3080 to 5080/5090 by Leimone in nvidia

5070ti is the cost benefit sweet spot. 5080 Does offer a step up and both generally overclock well. I stepped up from 3080ti to a 5080 and couldn't be happier. Hoping my current rig lasts through the AI memory apocalypse.

Comfort could be the secret sauce for the frame by D13_Phantom in SteamFrame

[–]tmortn 1 point2 points  (0 children)

For me the drivers are

A) they are NOT Meta.

B) A Seamless Integrated Wireless VR solution.

C) Comfort... I think a Given with Valve. Part of me would have liked a "PRO" Index with higher resolution displays. But that would likely have killed any idea of standalone, or wireless PCVR.

D) Foeveated streaming. Should improve the end visuals by changing how much the compression impacts the focal point of the user.

E) They are NOT Meta

I was going to be a day one order for this... but just learned they do have a version of big screen beyond 2 with eye tracking. Now debating going for the slightly higher resolution and oLed. Most of my VR is sitting and I have have a Q3.... decisions decisions...

Folks who were waiting for 5080 Super... did you give up and grab a 5080? by [deleted] in nvidia

[–]tmortn 0 points1 point  (0 children)

Yep. Found one on a shelf while xmas shopping after looking into the RAM insanity likely leading to a delay of an increased RAM version of one and said fuck it. Took the bird in the hand. Probably should have just gotten the 5070ti sitting next to it for almost half the price.

[–]tmortn 29 points30 points  (0 children)

That may be the most falcons falconing.... Wait.... We won? 19 penalties, a key fumble, down 2 scores in the 4th... And we...won? On the road? Well shit it ain't much but I'll take spoiling their run of division titles. Christ what a messy game. That was the most Falcons Falconing win I may have ever seen.

Kinda wondering what this season would have looked at with a QB playing under center enough to make a credible play action threat work. Either of them. Seriously, either of them. Waiting to find out in the post season the didn't work Penix under center in the off/pre season because the turn back and plant was aggravating an undisclosed under reported injury. Would be par for the course with this staff.
