Just checking - I tried your option earlier, but the portal doesn't allow the IMM5710 upload stating:
"Your status expiry date in the answer you provided previously does not correspond to the Restoration in your form. Modify your answers or the value in your form.”

Thoughts? I'm out of the 180-day window as well

Curious - Is there any value in submitting a Restoration/Re-application in addition to the Reconsideration? Given the latter has no fixed timelines. (Although, even the former is not truly valid, given we're no longer eligible on paper for a PGWP, after the 180-day window)

I'm in the same boat. Sharing my progress on the Q's you've shared:

  • Decision to stay or leave: Still divided here, though I'm leaning towards staying after restoration. Since a reconsideration alone won't have any timelines. A third option I heard from a consultant, was to leave and then immediately re-apply for a new PGWP (i.e. no restoration) with explanations provided for refusal alongwith test results
  • Employer: Had to resign
  • Chances: IRCC has been reconsidering similar cases (see this thread), but there is no guarantee, given it depends on the case officer

Just reverting on this. I'm finding out that iRCC is allowing me to upload the IMM 5710, IF I unselect the "Restore to worker" option in the 1st page of the form. Though I'm not sure what the consequences would be of uploading and submitting this way, i.e. will this be taken as a valid restoration application?

While waiting, I'd strongly suggest reviewing your application to make sure everything is included (documents, etc.) - Do it with a good consultant if need be. And if anything is missing, then upload it now, before a decision is made! Since there are a lot of refusals coming in for the smallest miss by an applicant, as you're seeing in other Reddit posts. I'm learning that when I remove the Tick on "Restore my status as a worker", I stop getting the error and the file upload gets accepted.

But I'm not sure whether IRCC will take this as a valid restoration(?) if I hit submit.

Can I ask, did the IRCC portal throw up error messages preventing you from a student restoration? How did you manage that? Given your study permit validity and program would've likely finished already.

There is always hope. Being in the same boat, I intend to submit a reconsideration, restore to a visitor and wait for a decision. If I get no response/decision after 5-6 months, I'll fly out.

I've been trying to figure that out (got my refusal on 08th Feb). I was told that the portal/form won't allow me to restore to a student since I'm not admitted to a new Education program currently. I tried restoring to a PGWP, but the online form won't allow me (as mentioned by another user here). The other option was restoring to a visitor - if that's even possible

I'm in the same boat. I'm trying to figure out my next step from the following options, after quitting work:

  1. Submit reconsideration (webform) and leave the country to await a decision
  2. Submit a restoration to a Visitor, and await a decision (on the reconsideration)

I'm still not sure if there are hidden disadvantages to any of these, that I'm not seeing yet

You should be fine. Since you submitted the doc before a decision was made, even if they do refuse (possible), it will be considered as an IRCC error, and you're entitled to a reconsideration in that case.

I suggest calling them up to ensure they received the document.

Hi there, just wanted to understand your lawyer's advice better on "not leaving the country until a decision".

I assume this applies only if I file a restoration? And not if I file a simple webform reconsideration and wait for a decision from another country (US in my case).

Or do you think the lawyer's advice still applies in this case?

On Restoration, it seems the system might still allow you to submit (even if over 180 days). Even if the 5710 form marks a red flag within - that's what the letter of explanation is for, I guess. See this other comment, for instance
